J THE CORPORATION OF THE TOWNSHIP OF KINCARDINE BY·LAW NO. .9/'- t:>?7'- Being a By-Law to establish for the Township of Kincardine a Municipal Civic Addressing System, including a civic addressing policy for the numbering of buildings along highways, for erecting property numbering sign blades and parts or for affixing numbers to the buildings. WHEREAS the Municipal Act, R.S.O. 1990, Chapter M.45, Section 210, Subsection 112, as amended, provides that a By-law may be passed for numbering the buildings and lots along any highway, b~ch, park, reserve or any other property in the municipality that it is considered necessary to number by council, and for affixing numbers to the buildings and for charging the owner with the expense incident to the numbering of the lot or property; AND WHEREAS the Municipal Act, R.S.O. 1990, Chapter M.45, Section 210, Subsection 113, as amended, provides that By-laws may be passed for keeping, and every such Council shall keep a record for the highways, beaches, parks, reserves and of the numbers of the buildings, lots and other property, if any, and for entering therein, and every such Council is hereby required to enter therein, a division of the streets with boundaries and distances for public inspection; AND WHEREAS the Council ofthe Corporation ofthe Township of Kincardine deems it expedient and necessary to adopt a Municipal Civic Addressing system for emergency response purposes and for other purposes and to provide authority to administration for its implementation; NOW THEREFORE the Council of the Corporation of the Township of Kincardine enacts as follows: 1. THATa municipal civic addressing system be established to provide for an accurate system of property identification as outlined in the Township of Kincardine Civic Addressing Policy Manual attached hereto and forming a part of this By-law; 2. THAT the addresses provided in Appendix 2 of the Township of Kincardine Civic Addressing Policy Manual, as amended from time to time, are hereby formally adopted as the civic addressing for the Township of Kincardine; 3. THATupdates and revisions may be made to the said Policy Manual after the date of the passing of this By-law by formal Resolution of the Council of the Corporation of the Township of Kincardine from time to time; 4. THAT Council may, at its option and by formal Resolution, charge the owner of each affected property with the expenditure incident to the numbering of the property or building; 5. THAT such expense may be collected in the same manner as taxes, or along with building permit fees; 6. THAT upon application for a building permit for a new structure on a vacant lot the sign fee would be collected along with the building permit fee; 7. THATno person except an employee of the Township of Kincardine as authorized, shall remove a property identification plate once it is posted; 8. THAT the property owner/tenant shall be responsible for the maintenance of the property sign and that it remains visible for vehicles travelling on their addressed road. 9. THATall owners of land and buildings which require an address, as determined by Council, are required to comply to the provision of this By-law; 10. THA Tno two lots or properties on a highway of the same name shall be designated by the same number; 11. THA Tonly those property identification sign blades or numbers, or mounting posts approved from time to time by Council for the Township of Kincardine and distributed through the Township of Kincardine may be erected on properties or buildings within the Township of Kincardine; 12. THAT the numbering procedures for the rural areas of the Township of Kincardine shall be in accordance with the number pattern for the Township of Kincardine as identified in the Policy Manual; 13. THAT every person who contravenes any of the provisions of this By-law shall be liable upon conviction to a fine not exceeding $5000.00, exclusive of costs, for each offence. 14. THAT should any section, clause or provision in this By-law be held by a Court of competent jurisdiction to be invalid, the validity of the remainder of this By-law shall not be affected; 15. THATany By-law or parts of any By-law passed under Section 210 Subsection 112 of the Municipal Act inconsistent with this By-law are hereby repealed; 16. THAT this By-law shall come into force and take effect upon the date of final passing thereof. READ A FIRST AND SECOND TIME AND NUMBERED THE DAY OF 97- d"¡' , 1997.
