HomeMy WebLinkAbout03 074 rd cl kin scot festiv ·..~ . e e TIlE CORPORATION OF TIlE MUNICIPALITY OF KINC INE BY-LAW NO. 2003 - 74 A BY -LAW TO TEMPORARILY CLOSE STREETS TO HOLD A KINCARDINE SCOTTISH FESTIVAL WHEREAS in accordance with Section 42 of the Municipal Act, 20 1, S.O. 2001, c. 25, as amended, authorizes the councils of all municipalities to close n a temporary basis any highway under the jurisdiction of the municipality for such social, recreational, community, athletic or cinema-graphic purpose as may be specifie in a by-law; I AND WHEREAS the Kincardine Scottish Festival and Highland Gr~mes wishes to hold an event July 4-6, 2003 at Victoria Park in the Municipality of Kincarine; NOW THEREFORE the Council for The Corporation of the Munifipality of Kincardine ENACTS as follows: ¡ 1. That Durham Market South be closed to all vehicular traffic n Friday July 4, 2003 from 6:00 p.m. until 6:00 p.m. Saturday July 5, 003. That Durham Market North, portion of Russell Street from P 'nces Street to Victoria Street, portion of Princes Street from Lambton Sou to Dead End and portion of Queen Street from Gordon Street to Durham treet be closed to all vehicular traffic on Saturday, July 5, 2003 from 7:00 a.m. to 6:00 p.m. The Kincardine Scottish Festival shall erect at each endfof such highway or portion thereof, and where an altemative route deviates t erefore, a barricade upon which an adequate waming device shall be exposed and in good working order continuously from sunset until sunrise and at such IPoints there shall be erected a detour sign indicating the altemative route and ~ntaining a notice that the highway is closed to traffic. ' 2. 3. Every person who uses a highway or portion of a highw y so closed to traffic does so at his or her own risk and The Corporation f the Municipality of Kincardine is not liable for any damage sustained by a pe on using the highway or portion thereof so closed to traffic. 4. Every person who without lawful authority uses a highway r portion thereof so closed to traffic while it is protected in accordance with this aragraph, or who removes or defaces any barricade, device, detour sign or n tice placed thereon by lawful authority, is guilty of an offence and is subject to t e penalties as set forth in the Provincial Offences Act and is also liable to the he Corporation of the Municipality of Kincardine for any damage or injury oc sioned by such wrongful use, removal or defacement. 5. .../2 e e e e By-Law No. 2003 - 74 Scottish Festival 2003. This by-law may be cited as the "Scottish Festival 2003~ Temporary Street Closure, By-law". READ a FIRST, SECOND and THIRD time and DEEMED TQ BE PASSED this 4th day of June, 2003.
