BEING A BY -LAW TO AMEND ZONING BY -LAW NO. 2003 -25,
BEING THE COMPREHENSIVE ZONING BY -LAW FOR THE
MUNICIPALITY OF KINCARDINE

WHEREAS the Council for the Corporation of the Municipality of Kincardine
adopted By -law No. 2012 -049, amending By -law No. 2003 -25, the Zoning By -law
for the Municipality of Kincardine;
AND WHEREAS By -law No. 2012 -049 placed certain lands in a `R3 -k -H'
Residential Three Special Holding' category and specified the use to which
lands, buildings or structures may be put until such time as the holding symbol is
removed pursuant to Section 36 of the Planning Act, R.S.O. 1990, c. P. 13;
AND WHEREAS the provisions relating to the removal of the holding symbol
contained in Municipality of Kincardine By -law No. 2003 -025 Section 14.3.10 (ii
and iii) have been satisfied;
NOW THEREFORE the Council of the Corporation of the Municipality of
Kincardine, ENACTS as follows:
• 1. Schedule `A' to By-law No. 2003 -25 as amended, is hereby further

amended by changing thereon from `R3 -k -H ` to `R3 -k' the zoning
designation of those lands described as Part of Block 52, Plan 3M -226,
Municipality of Kincardine (geographic Town of Kincardine) which are
outlined on the attached Schedule `A'.
2. By -law No. 2003 -25, as amended, being the Comprehensive Zoning By-
law for the Municipality of Kincardine, is hereby further amended by
deleting and replacing the following paragraph to subsection 14.3 thereof:
14.3.10 Notwithstanding their `R3' zoning designation , those lands
delineated as `R3 -k' on Schedule `A' to this By -law may be used for
`Residential Three' purposes in compliance with the `R3' zone provisions
contained in this By -law, excepting however, that:
(i) Single detached dwellings, Semi - detached dwellings, Duplex
dwellings, and Boarding houses are not permitted Residential uses

• 3. This By -law shall come into force and effect on the final passing thereof by
the Council of the Corporation of the Municipality of Kincardine, subject to
compliance with the provisions of the Planning Act, R.S.O. 1990.
4. This By -law may be cited as the "Amendment to Comprehensive Zoning
By -law No. 2003 -25 Part of Block 52, Plan 3M -226 [geographic Town of
Kincardine]) By -law ".
