BEING A BY -LAW TO DESIGNATE THE PUBLIC BUILDING AT
707 QUEEN STREET, MUNICIPALITY OF KINCARDINE
(VICTORIA PARK & KINCARDINE CENTRE FOR THE ARTS)
AS BEING OF HISTORIC OR ARCHITECTURAL VALUE
WHEREAS Section 29 (1) of the Ontario Heritage Act, R.S.O. 1990, c. 0.18, as
amended, authorizes the Council of a municipality to enact by -laws to designate
• a property within the municipality to be of cultural heritage value or interest;
AND WHEREAS the Council of the Municipality of Kincardine has caused to be
served upon The Ontario Heritage Foundation, notice of intention to so designate
the aforesaid property and has caused such notice of intention to so designate
the aforesaid real property to be published in a newspaper having general
circulation in the Municipality;
AND WHEREAS the reasons for designation are set out in Schedule "B"
attached hereto;
AND WHEREAS by By - law No. 4144, "Being a By -law to Designate The Victoria
Park (Durham Market Square) of Architectural Value ", designated Victoria Park
of being of historic and /or architectural value or interest;
AND WHEREAS the information contained in By -law No. 4144 is outdated;
NOW THEREFORE the Council of The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. There is designated as being of architectural value and interest the real
property more particularly described in Schedule "A" hereto, known as The
• Kincardine Centre for the Arts, 707 Queen Street, Municipality of
Kincardine, Ontario.
2. The Clerk is hereby authorized to cause of copy of this by -law to be
registered against the property described in Schedule "A" hereto in the
proper land registry office.
3. The Clerk is hereby authorized to cause a copy of the by -law to be served
upon the owner of the aforesaid property and upon The Ontario Heritage
Foundation and to cause notice of this by -law to be published in a
newspaper having general circulation in the Municipality of Kincardine.
4. That By -Law No. 4144 registered on June 13, 1978 with Instrument
Number R159267 and on the lands described in PIN Number 33313 -0551
being part of Durham Market Square, being parts 2 and 3 on reference
Plan 3R -2164, Municipality of Kincardine, County of Bruce be repealed in
its entirety.
5. This by -law shall come into full force and effect upon its final passing.

By -law No. 2012 -099
Designation Statement:
• Designation for Victoria Park and Kincardine Centre for the Arts (former Town
Hall) shall include all named features listed below.
Description of Property and Heritage Features:
Designation shall cover the park property named Victoria Park, including the two
cannons from the Crimean War (Sch. C #1), the fountain built in honour of Queen
Victoria's Golden Jubilee on May 4, 1897(Sch. C #2), the Pipe Band Cairn (Sch.
C #3) and historic bell located in front of the former Town Hall building (Sch. C
#4), but not the gazebo located in the middle of the park. The designation shall
also include specific components of the yellow brick building which was built in
1872.
The specific components of the former Town Hall which are to be designated
include the historically replicated north end veranda, and historic windows and
associated brickwork. It shall include the restored exterior areas of the fagades,
storm windows, the wooden doors on the northwest and southwest corners of the
building, and northeast corner wooden doors, all the roof gables and the veranda
• on the north end of the building.
Repair or restoration work performed on the designated areas, which is
completed with same material and does not change the look of the restored
structure may be performed without prior approval from Heritage Kincardine
unless a building permit is required. Regular and required maintenance on the
grass, trees and gazebo within the park is acceptable if performed by the
Municipality of Kincardine.
Areas that do not fall under the designation include the west glass entranceway,
entrance way ramp, elevator addition, interlocking brick under the veranda, or
any components within the interior of the building. The red brick building (former
fire hall) to the south of the historic Town Hall is also not considered a part of the
designation.
Statement of Cultural Heritage Value:
This yellow brick building, completed in 1872, was originally built with municipal
offices and a fire hall on the main floor, and an auditorium with a stage on the
. second floor. It served as the centre for local political decisions for the former
Town of Kincardine for over 100 years; the auditorium was the Town's cultural
centre.
Much of the original structure was physically modified in the mid 20 century,
including replacement of the original windows and removal of the west gable,
cupola and veranda.
In 1999, amalgamation of the Town of Kincardine with Township of Kincardine
and the Township of Bruce saw local political administration relocate to the 5th
concession of the former Township of Kincardine and it ceased to be a Town
Hall. It subsequently became the home of various arts and culture groups and is
now known as the Kincardine Centre for the Arts.
An elevator was installed in the mid 2000's on the east side of the building.
In 2011, a two year restoration project concluded and saw the restoration of the
exterior of this important building back to its original look.

The surrounding park, originally established as a market place in 1850, continues
to be one of the most important cultural community gathering locations, hosting
farmers' markets as well as the weekly summer Pipe Band Parade.

The original designation by -law contains photographs of the Kincardine Centre
for the Arts, 707 Queen Street, Municipality of Kincardine, Ontario and are filed
• with the Clerk of the Municipality of Kincardine.
