1. By-law No. 82-08, being the Restricted Area By-law
of the Corporation of the Township of Kincardine,
is hereby flll,ther' am""deu by deleting par'agraph (1')
of subsection 6.17.1 and replacing it with the
following paragraph (1'):

"R3" the Zoning designation of those lands
described as part of Lot 60, Concession 'A', in the
Township of Kincardine, as shown outlined in the
heaviest black broken line on the attached Schedule

A satellite dish shall only be located within
a rear yard within any zone which permits
residential uses and such satellite dish shall
not exceed 4.5 metres in height, excepting,
however, that;
( i ) On a corner lot, a satell i te dish shall
only be Jocated within a rear yard or an
interior side yal'd.

By-law No. 82-08 as amended, is hereby further
amended by deleting subsection 6.10 and replacing
it with the following subsection 6.10:
6.10 EXCEPTION TO MAXIMUM HEIGHT REGULATIONS
The regulations prescribing the maximum height
of any building or structure shall not, in any
zone, apply to flag poles, radio or television
receiving or transmitting equipment (not
including satellite dishes), grain elevators,
windmills, farm silo or barns, church spires,
belfries, cupolas, pent-houses, towers or
domes not used for human occupancy, chimneys,
smoke stacks, ventilators, skylights, water
tanks, scenery lofts, bulk heads, firewalls
and similar features and necessary mechanical
appurtenances accessory to the building on
which they are erected, including any roof
signs erected and/or maintained in accordance
wi th any by-law or regulation of the
municipality from time to time in force;
provided that however, that such features are
erected only to such heights as is necessary
to accomplish their purpose,
13. This By-law takes effect from the date of passage
by Council and comes into force pursuant to the
provisions of The Planning Act, 1983.
