THE CORPORATION OF THE TOWNSHIP OF ~INCARDINE
BY-LAW NO. 91-09
A BY-LAW TO AMEND BY-LAW NO. 82-08, AS AMENDED, BEING
THE RESTRICTED AREA BY-LAW OF THE
CORPORATION OF THE TOWNSHIP OF KINCARDINE
THE COUNCIL of the Corporat10n of the Townsh1P of Kincardine,
pursuant to Section 24 of the Planning Act. 1983, ENACTS as
follows:
1. BY-Law No. 32-08, as amended, 1S hereby further amended by
aeleting paragrapn Ip) of Subsect10n 6.1ï.l and replacing
it with the foJlowlng paragraph (p):
(p) Automobile Car Wash
3 spaces per car wash bay.
2. By-law 82-08, as amended. is hereby further amended by
deleting paragraph (r) of Suosection 6.1ï.1 and replacing
it with the follow1ng paragraph (r):
(r) Automob1le Service
Station
3 spaces per service
bay or 3 spaces minimum,
whichever is greater
3. By-law No. 8Z-08, as amended, is hereby further amended by
adding the following permitted use to Subsection 30.1 (b)
thereof:
an accessory building for the
administration or storage facilities
purpose
of
4. Schedule "A", Map 1 to By-law No. 8Z-08, as amended, is
hereby further amended by changing thereon from "PD" to
"R3" the Zoning designation of those lands described as
part of Lots 59 and 60, Concession 'A', in the Township of
Kincardine, as shown outlined on the attached Schedule
"A".
5. SChedule "A", Map 1 to By-law No. 8Z-08, as amended, is
hereby further amended by changing thereon from "cz" to
"R3" the Zoni ng des 1 gnat i on of those 1 ands descri bed as
part of Lot 60. Con cess 1 on 'A'. 1 n the Townshi p of
Kincardine, as shown outlined on the attached Schedule
"A" .
6. By-law No. 82-08, as amended, 1S hereby further amended by
add1ng the follow1ng paragraph (b) to Subsection 14.4
thereof:
(b) Notwi thstand i ng the i r "R3" Zom ng des 1 gnat ion, on
those lands descrlbed as Part of Lot 60, Concession
"A", Township of Kincardine and delineated as 'R3-Z'
on Schedule "A" to this By-law, the existing
residential dwelling may be used for the purposes of
a commercial accounting establishment in compliance
with the 'cz' Zone provisions conta1ned in this By-
law, in addition to the normal 'R3' uses.

9. Schedule "A", Map 2 to By-law No. 82-08, as amended, is
hereby further amended by chang1ng thereon from "PD" to
"R3" the Zon 1 ng des 1 gnat 1 on of those J ands descr i bed as
part of Lots 52 and 53, Concession "A", in the Townsh1p of
Kincardine, as shown outlined on the attached Schedule
"c" .
10. Schedule "A", Map No.2 to By-law No. 82-08, as amended,
is hereby further amended by changing thereon the
designation of the road located in part of Lots 52 and 53,
Concession "A", in the Township of Kincardine from a Class
1 road to a pri vate road, as shown out 11 ned on the
attached Schedule "C".
11 . By-l aw No. 82-08, as amended, is hereby further amended by
adding the fOllowing Subsection 5.110.1 to Section 5
thereof:
5.110.1
'SATELLITE DISH' means a device intended for or
capable of being used for receiving or
collecting communication signals from a
satellite.
12. By-law No. 82-08, as amended, is hereby further amended by
adding the following Subsection 6.32 to Section 6 thereof:
6.32 SATELLITE DISHES
A satellite dish shall only be located w1thin a rear
yard in any Zone which permits res1dential uses and
such satellite dish shall not exceed 4.5 metres in
height, excepting, however, that:
(i) On a corner lot, a satellite dish snall only be
located within a rear yard or an interior side
yard.

6.10 EXCEPTION TO MAXIMUM HEIGHT REGULATIONS
The regulations prescribing the maximum height of
any bui lding or structure shall not, in any Zone,
apply to flag poles, radio or television receiving
or transmitting equipment '(excluding satell ite
dishes), grain elevators, windmills, farm silo or
barns, church spires, belfries, cupolas, pent-
houses, towers or domes not used for human
occupancy, chimneys, smoke stacks. ventilators,

skylights, water tanks, scenery lofts. bulk heads,
flrewalls and slm1lar features and necessary
mechan1cal appurtenances accessory to the bU11ding
on Wh1Ch they are erected, 1nclud1ng any roof slgns
erected and/or ma1nta1ned 1n accordance w1th any By-
law or regulation of the mun1c1pality from time to
time 1n force; prov1ded, however, that such features
are erected only to such he1ghts as 1S necessary to
accomplish the1r purpose.
14. By-law No. 86-22 1S hereby repealed.
15. Th is By-l aw takes effect from the date of passage by
Counc1] and comes into force pursuant to the provisions of
The Planning Act, 1983.
