THE CORPORATION OF THE TOWNSHIP OF KINCARDINE
BY-LAW NO. 92-04
(JOHNSON)
A BY-LAW TO AMEND BY-LAW NO. 82-08,
AS AMENDED BEING THE COMPREHENSIVE ZONING BY-LAW OF
THE CORPORATION OF THE TOWNSHIP OF KINCARDINE
The Council of the corporation of the Township of
Kincardine, pursuant to Section 34 of The Planning Act, 1983,
ENACTS as follows:
1. By-Law No. 82-08, as amended, being the Comprehensive Zoning
By-Law of the Corporation of the Township of Kincardine, is
hereby further amended by adding the following Subsection
9.3.16 (a) and (b) to Section 9.0 thereof:
9.3.16 (a)
Notwithstanding their "AI" Zoning
designation, those lands described as Part
Lot 39, Concession 3 NDR in the Township of
Kincardine and delineated as "AI-92-04a" on
Schedule "A" to this By-Law may be used for
non-farm residential purposes in compliance
with the "AI" Zone provisions contained in
this By-Law, excepting however, that:
(i) the "Minimum Lot Area" shall be 2.23
hectares (5.5 acres); and,
(ii) the "Minimum Lot Frontage" shall be 142
metres (466 feet).
9.3.16 (b)
Notwithstanding their "AI" Zoning
designation, those lands described as Part of
Lot 39 and 40, Concession 3 NDR, in the
Township of Kincardine and delineated as
"AI-92-04b" on schedule "A" to this By-Law,
may be used for agricultural purposes in
compliance with the "AI" Zone provisions
contained in this By-law, excepting however
that:
i ) the "Minimum Lot Area" shall be 48.3
hectares (119.24 acres);
11) the "Minimum Lot Frontage" shall be
260.3 metres (854 feet) ; and,
iii) no new residential structures shall be
permitted.
2. Schedule "A" of By-Law No. 82-08, as amended, is hereby
further amended by changing thereon from "AI" to "AI-92-
04a", and from "AI" to "Al"-92-04b" the Zoning designation
of those lands described as Part of Lot 39 and Lot 40,
Concession 3 NDR, in the Township of Kincardine, as shown
outlined in the heaviest black broken line on the attached
Schedule "A".

3. This By-Law takes effect from the date of passage by Council
and comes into force and effect pursuant to the provisions
of The Planning Act, 1983.
