THE CORPORATION OF THE TOWNSHIP OF KINCARDINE
BY-LAW NO. 92-19
BEING a by-law to authorize the establishment of a "sewage works" in the
Township of Kincardine and to provide for a sewer rate sufficient to pay for
the capital costs of the sewage works and to impose a sewage service rate
upon the owners or occupants of tbe land who use the sewage works.
WHEREAS paragraph 84 of Section 210, of The MunicipaJ Act, RS.O. 1990,Chapter
M-45, paragraph 8, authorizes the council of a municipality to pass by-laws
establishing, acquiring, operating and maintaining sewage systems;
AND WHEREAS paragraph 98 of Section 210 of the said Act authorizes the council
of local municipalities to procure investigations and reports as to sewage works;
AND WHEREAS Section 221(2) of the said Act authorizes the council of a local
municipality to pass by-laws imposing a sewer rate upon owners or occupants of land
who derive or will or may derive a benefit therefrom sufficient to pay for the capital
costs of a municipal sewage works;
AND WHEREAS Section 221 of the said Act authorizes the 10caJ municipality to
designate the land for which the owners or occupants are liable to the sewer rate;
AND WHEREAS by Section 218 (20) of the said Act, the council of a municipality
may by by-law, impose upon owners or occupants of land who use sewage works a
sewage service rate;
AND WHEREAS it was desirous that a sewage works be established for the benefit
of the residents of the Marine Shore Allowance lying to the west of Lots 66, 67, 68
and 70, in the Township of Kincardine, County of Bruce, or more specifically the area
bound by County Road No. 15 to the north, Lake Street to the east, Cedar Street to
the south and Lake Huron to the west;
AND WHEREAS the Corporation has entered into Agreements of Purchase and
Sale for the sale of parts of the Marine Shore Allowance with each of the residents
of the Marine Shore Allowance in the area described above (hereinafter called the
"Marine Allowance Purchasers");
AND WHEREAS an engineering study and professional opinion have been received
with respect to the necessity, utilization, design and related matters regarding the
works and the said study has been reviewed and adopted by the council of the
Township of Kincardine;
NOW THEREFORE be it enacted and it is hereby enacted by the council of the
Township of Kincardine as follows:
ESTABLISHMENT OF SEWAGE WORKS
1.
(a) A sewage works be established in the Township of Kincardine for the
benefit of the residents of the Marine Shore Allowance lying to the west of
Lots 66, 67, 68, 69 and 70, Concession "A", in the Township of Kincardine,
County of Bruce.
(b) That the sewage works be established at an estimated cost of
$570,475.00. The estimated costs are as outlined below:

The estimated costs have been caJculated in accordance with the plans and
specifications prepared by Paragon Engineering Umited, Consulting
Engineers.
(c) That the said fum on behalf of the Township of Kincardine prepare
plans, profiles, specifications and such other information as may be necessary
for inviting tenders to carry out the construction of the works.
(d) That the initial cost of the works be paid from the revenue generated
by the saJe of part of the Marine allowance by the Township to each of the
Marine Allowance Purchasers as set out in the Agreements of Purchase and
Sale entered into between the Township of Kincardine and the Marine
Allowance Purchasers.
(e) That the construction of the works is conditionaJ upon all necessary
approvals from the various review agencies, including, but not limited to, the
Ministry of the Environment, the Bruce-Grey-Owen Sound HeaJth Unit,
Ontario Hydro, Village of Tiverton, Ministry of Municipal Mfairs and Bruce
County Planning Department.
(t) That the extent of the works are conditional on the Township of
Kincardine being granted all required easements over private lands for the
purpose of providing the works to the benefitting land.
2. The owners or occupants of all land within the area of immediate benefit, as
established by this by-law shall be liable for the sewer rate to pay the capital
costs of the sewage works.

The land to which immediate benefit is derived upon completion of the works
is the land within the Township of Kincardine as shown on the site plan
prepared by Paragon Engineering Umited, dated February, 1992, a copy of
which is attached as Schedule "A" to this by-law, and being the lands occupied
by all the residents of the Marine Shore Allowance lying to the west of Lots
66, 67, 68, 69 and 70, Concession "A", in the Township of Kincardine, County
of Bruce.
4. The owners of residence or occupants of land within the area of immediate
benefit, that shall be liable to pay the sewer rate, are those owners listed on
Schedule "B" of this by-law, being the owners of record of the residences
within the area of immediate benefit as of January 31, 1992, and their heirs,
executors, administrators and assigns.
5. The sewer rate for each parcel of land within the area of immediate benefit
shall be $20,000.00 less the amount of the surplus funds refunded to the owner
of such parcel in accordance with the terms of the Agreements of Purchase
and Sale.
6.
The owners and occupants of lands within the Township of Kincardine who
are not within the area of immediate benefit but who request or are required
to be connected to the sewage system and are allowed to connect to the
sewage system at some future date, shaJl be liable to pay a sewer rate
determined by the Kincardine Township Council, from time to time. Such
amount to be not less than $4,500.00 plus any direct additional future capital
costs of these new connections including but not limited to the applicable
Ontario Hydro Treatment PlaDt buy-in costs attributable to the

interconnection to the Village of Tiverton's forcemain. The specified amount
($4,500.00) will be indexed from year to year, according to the CPI.
7.
The charges imposed under paragraph 6 hereof shall be due and payable at
the time of connection of the sewage system.
8. The Township shall use any monies collected from future connections for:
(a) AdditionaJ future capital cost improvements referred to above.
(b) To top up the reserve fund ($30,000.00 maximum) as required by the
Ministry of the Environment and once points (a) and (b) are
accommodated, to
(c) Split any excess, two-thirds (%) to the Township for the GeneraJ Fund
and one-third (Va) to the reduction of the annuaJ maintenance costs of
the Inverhuron system.
