THE CORPORATION OF THE MUNICIPALITY OF KINC INE
NO. 2003 -158
BEING A BY-LAW TO CLOSE CALDWELL AND ELIZABET STREETS,
PLAN 163 AND CALDWELL, CAROLINE, ELIZABETH AND J HN STREETS,
PLAN 212, MUNICIPALITY OF KINCARDINE, FORMER TO NSHIP OF
KINCARDINE, COUNTY OF BRUCE, TO PUBLIC TRAVE AND TO
ESTABLISH THE PRICE AND AUTHORIZE THE SALE 0 THE SAID
CLOSED STREETS TO THE ADJOINING OWNE S
WHEREAS the Municipal Act, 2001, S.O. 2001, c.25, "The Act" ~rovides as
follows: ,
1. A lower tier Municipality may pass by-laws in respect of a ighwayover
which it has jurisdiction (s.27(1».
2. Before passing a by-law for permanently closing a highwa a Municipality
shall give public notice of its intention to pass the by-law ( .34)(1 )).
3. A Municipality may pass by-laws prescribing the form and manner of
giving notice required by the Act (s.251). '
4. A Municipality may pass by-laws establishing procedures I oveming the
sale of land (s.268). . . f

AND WHEREAS:
At a meeting of the Planning Review, By-law Enforcemen and Building
Committee of the Municipality of Kincardine held on Sept mber 9, 2002 it
was agreed that the streets on Plan 212 and 163 in the fo erTownship
of Kincardine be closed and sold to the adjoining owners.
6. By By-law 2003-133 the Municipality of Kincardine establi hed procedures
for the sale of surplus real property.

7. By By-law 2003-102 dated July 9,2003 the Municipality 0 Kincardine
established procedures for the form and manner of giving notice when
required by the Act.
8. Public notice of the intention to pass this by-law was give in the form
attached to this by-law as Schedule "B" and in the manne required by By-
law 2003-102.
9. The lands described in this by-law were declared surplus 0 the needs of
the Municipality by Resolution #2003-569 dated October ,2003.
10. No one appeared or otherwise notified the Council of the unicipality of
Kincardine of any reason why the said streets should not e closed
permanently to public travel.

NOW THEREFORE the Council of the Municipality of Kincardine ønacts as
follows:
1.
That the streets on Registered Plan 163 and 212 in the Muricipality of
Kincardine, formerly the Township of Kincardine, County ot Bruce and
more particularly described in Schedule "A" attached to thi$ by-law be
closed permanently to public travel.
That Caldwell Street, Plan 163 being Part 1, Plan 3R-7711! be sold to the
adjoining owner, Hazel McLelland.
That the remaining streets being Parts 2, 3 and 4, Plan 3Rt7711 be sold to
the adjoining owner, Steven McLelland. '

That the purchase price of the lands are established as 50flo of all costs
incurred in completing all procedures required to close an~ convey the
said lands to them, including but not limited to appraisal, lE19al,
administrative and all disbursements including deed regist~ation, costs,
land transfer tax and applicable GST. .
That the CAO and Mayor of the Municipality of Kincardine fire authorized
to sign the deeds and such other documents as may be re~uired to
complete the sale of the lands authorized by this by-law. ,
6. That the sale shall not be completed until all agreed costs þrovided for in
this by-law have been paid or satisfactory arrangement to þay have been
made with the CAO of the Municipality of Kincardine. .

7. This by-law shall come into full force and effect upon its firial passing.
8. This by-law may be cited as the "McLelland/Bervie S~bdivision Road
Closure and Sale By-Law".

AFFIDAVIT OF CLERK
1. I am the clerk of the Municipality of Kincardine and, as such, have
the knowledge of the facts hereinafter deposed to.
2. I caused notice of a proposed by-law Notice of intention to permanently
close Caldwell Street and Elizabeth Street, Plan 163 described as Parts 1
and 2 on Reference Plan 3R-7711 and Elizabeth Street, Plan 212
designated as Part 3 on 3R-7711 and Caldwell Street, Caroline Street and
John Street, Plan 212 designated as Part 4, Plan 3R-7711 and to sell the
said land to be published in The Kincardine News and the Kincardine
Independent on the following dates:
i) October 15, 2003
ii) October 22,2003
iii) October 29,2003
3. Attached hereto as Schedule "B" to this my affidavit is a copy of the actual
notice which was published in The Kincardine News and the Kincardine
Independent on each of the above -mentioned dates.
4. The proposed by-law came before the Council of The Municipality of
Kincardine on the 5th day of November 2003 and no one appeared in
person or by counsel to make representation with respect to the proposed
by-law.
