BEING A BY-LAW TO ACCEPT A TENDER FOR tHE
SUPPLY AND APPLY CALCIUM CHLORIDE i
IN WARDS TWO AND THREE
(Da-Lee Dust Control)

WHEREAS the Council for The Corporation of the MunicipalIty of Kincardine
deems it expedient to accept a, tender for the supply and apply or calcium chloride
in Wards 2 and 3 pursuant to Contract No. 2003-03. !

NOW THEREFORE the Council for The Corporation of th',' Municipality of
Kincardine ENACTS as follows:
1. That the tender of Da-Lee Dust Control in the amou~t of $82,405.62
including all applicable taxes, be hereby accepted for the supply and apply
of calcium chloride in Wards 2 and 3. I

That the Mayor and CAO be hereby authorized to sign,¡ on behalf of the
Council for The Corporation of the Municipality of Kincarqine any contracts
and other documents required to authorize such work to 9ommence, and to
affix the corporate seal of The Municipality of Kincardine.
This by-law shall come into full force and effect upon its fital passage.
This by-law may be cited as the "Calcium Chloride in Wards 2 and 3,
Tender Acceptance By-law".
READ a FIRST, SECOND and THIRD time and DEEMED TO BÞ PASSED this
2nd day of April, 2003. r

hereinafter called the "Contractor"
THE PARTY OF THE FIRST PART

hereinafter called, the "Municipality"
THE PARTY OF THE SECOND PART
WITNESSETH, that the party of the first part, for and in consideration of the payment or payments
specified in the Tender for this work, hereby agrees to furnish all necessary machinery, tools,
. j equipment, supplies, labour, and other means of construction and, to the satisfaction of the Public
Works Manager, to do all the work as descn'bed hereafter, furnish all the materials except as herein
otherwise specified, and to complete such works in strict accordance with the plans, specifications and
I Tender therefore, which are identified and acknowledged in the Schedule of Provisions, Plans,
, Specifications and Conditions attached to the Tender and all of which are to be read herewith and form
part of this present Agreement as fully and completely to all intents and purposes as though all the
stipulations hereofhave been embodied herein.
DESCRIPI10N
Contract No. 2003-03 - Supply and Apply Calcium Chloride at a tendered price of S8Z,405.62,
including taxes.
IN CONSIDERATION WHEREOF, said party of the second part agrees to pay to the Contractor for
all work done, and the unit prices on the Tender.

This agreement shall ensure to the benefit of and the binding upon the heirs, executors, administrators
and assigns of the parties hereto.
IN WITNESS WHEREOF, the Contractor and the Municipality have hereunto signed their names and
set their seals on the day first above written.
