THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY-LAW
NO. 2001 -126
A BY-LAW TO TEMPORARILY CLOSE STREETS IN KINCARDINE
TO FACILITATE THE KINCARDINE & DISTRICT CHAMBER OF COMMERCE
SANTA CLAUS PARADE
WHEREAS in accordance with subsection 207(44) of the Municipal Act, R.S.O.
1990, Chapter M.45, as amended, authorizes the councils of all municipalities to
close on a temporary basis any highway under the jurisdiction of the municipality
for such social, recreational, community, athletic or cinematographic purpose as
may be specified in a by-law;
. AND WHEREAS the Kincardine and District Chamber of Commerce wishes to
hold a Santa Claus Parade on December 1, 2001 starting at 6:30 p.m.;
NOW THEREFORE the Council for The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That the parade route shall consist of that portion of Gary Street, (Sutton
Park Mall) south of Phillip Place; west on King Street; south on Sutton
Street; west on Broadway Street; south on Queen Street; east on Durham
Market N; and culminating in Victoria Park, shall be closed to vehicular
traffic Saturday, December 1st, 2001 from 6:00 p.m. to 8:30 p.m. for the
Kincardine & District Chamber of Commerce Santa Claus Parade.
2.
That the Kincardine Public Works Department shall, along the Santa
Clause Parade route, erect at each end of the highway or portion thereof,
and; where an alternative route deviates therefore, all necessary
barricades and shall erect detour signs indicating the alternate route and
containing a notice that the highway is closed to traffic.
3. Every person who uses a highway or portion of a highway so closed to
traffic does so at his or her own risk and The Corporation of the
Municipality of Kincardine is not liable for any damage sustained by a
person using the highway or portion thereof so closed to traffic.

Every person who without lawful authority uses a highway or portion
thereof so closed to traffic while it is protected in accordance with this
paragraph, or who removes or defaces any barricade, device, detour sign
or notice placed thereon by lawful authority, is guilty of an offence and is
subject to the penalties as set forth in the Provincial Offences Act and is
also liable to The Corporation of the Municipality of Kincardine for any
damage or injury occasioned by such wrongful use, removal or
defacement.

This by law shall come into full force and effect upon its final passage.
6.
This by-law may be cited as the "Santa Claus Parade Temporary Road
Closure By law, 2001".
READ a FIRST, SECOND and THIRD time and FINALLY PASSED this
24th day of October, 2001.
