BY-LAW
NO. 2001 - 49
A BY-LAW TO TEMPORARILY CLOSE STREETS TO HOLD A
KINCARDINE SCOTTISH FESTIVAL
WHEREAS in accordance with subsection 207(44) of the Municipal Act, R.S.O. 1990,
Chapter M.45, as amended, authorizes the councils of all. municipalities to close on a
temporary basis any highway under the jurisdiction of the municipality for such social,
recreational, community, athletic or cinema-graphic purpose as may be specified in a
by-law:
NOW THEREFORE the Council for The Corporation of the Municipality of Kincardine
ENACTS as follows:
1. That portion of Durham Market North from the intersection with Queen Street to
the intersection with Princes Street; that portion of Durham Market South from
the intersection with Princes Street to approximately the half way point to Queen
Street, such that businesses thereon may have road access; that portion of
Princes Street running from the northern entrance of the municipal parking lot to
its southern dead end at the river bank; that portion of Russell street running
from Princes Street to the Russell Street intersection with Victoria, be closed to
all vehicular traffic on Saturday July 7, 2001 from 07:00 A.M. to 11 :00 P.M.

The Kincardine Scottish Festival shall erect at each end of such highway or
portion thereof, and where an alternative route deviates therefore, a barricade
upon which an adequate warning device shall be exposed and in good working
order continuously from sunset until sunrise and at such points there shall be
erected a detour sign indicating the alternative route and containing a notice that
the highway is closed to traffic.

Every person who uses a highway or portion of a highway so closed to traffic
does so at his or her own risk and The Corporation of the Township of
Kincardine-Bruce-Tiverton is not liable for any damage sustained by a person
using the highway or portion thereof so closed to traffic.

Every person who without lawful authority uses a highway or portion thereof so
closed to traffic while it is protected in accordance with this paragraph, or who
removes or defaces any barricade, device, detour sign or notice placed thereon
by lawful authority, is guilty of an offence and is subject to the penalties as set
forth in the Provincial Offences Act and is also liable to the The Corporation of
the Municipality of Kincardine for any damage or injury occasioned by such
wrongful use, removal or defacement.

This by-law shall come into full force and effect upon its final passage.

This by-law may be cited as the ·Scottish Festival 2001, Ternporary Street
Closure, By-law".
