THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY-LAW
NO. 2001 -146
BEING A BY-LAW TO AUTHORIZE THE TEMPORARY CLOSING
OF A MUNICIPAL ROAD
WHEREAS the Municipal Act R.S.O. 1990, Chapter 302, Section 207,
Paragraph 43 authorizes Council to pass By-Laws for temporary road closing.
NOW THEREFORE the Council for The Corporation of the Municipality of
Kincardine deems it necessary to temporarily close a section of side road 25 - 26
between Concession 7 and Concession 9, in the former Township of Kincardine;
1. The Road Allowance designated as Side road 25 - 26 and described in
part as being approximately 200 meters north of Concession 7 to a point
approximately 700 meters south of Concession 9 (being of approximately
1.1 KM) will be temporarily closed for repairs.
2. Every person who uses this portion of closed road does so at his own risk,
and the municipality is not liable for any damage sustained by a person
using this road so closed to traffic.

Every person who without lawful authority uses the portion of road so
closed to traffic, or who removes or defaces any barricade, device, sign or
notice placed thereon by lawful authority, is guilty of an offence and is also
liable to the former Township of Kincardine for any damage or injury
occasioned by such wrongful use, removal or defacement.
4.
That the former Township of Kincardine By-Law no. 93-34 be hereby
repealed.
5. This by-law shall come into full force and effect upon its final passing.
6. This by-law may be cited as the" Temporary Road Closure Side
Road 25 - 26 By-Law".
