HomeMy WebLinkAbout01 023 amend 76-13 bru twp opg e e e e THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY-LAW No. 2001 - 23 BEING A BY-LAW TO AMEND ZONING BY-LAW NO. 76-13, BEING THE COMPREHENSIVE ZONING BY-LAW FOR THE FORMER TOWNSHIP OF BRUCE (OPG, Part of Lots 11-30, Concession A) MUNICIPALITY OF KINCARDINE (FORMER TOWNSHIP OF BRUCE) WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapter 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws which comply with an approved official plan; AND WHEREAS the Council of the Municipality of Kincardine has enacted By- law 76-13, a zoning by-law enacted under Section 34 of the said Planning Act; AND WHEREAS the Council of the Municipality of Kincardine desires to amend By-law 76-13; NOW THEREFORE the Council of the Municipality of Kincardine ENACTS as follows: 1. Schedule 'A' to By-law No. 76-13 as amended, is hereby further amended by amending the permitted uses in the G-R zone for those lands described as Part of Lots 11-30, Concession 'A, Municipality of Kincardine (former Township of Bruce) which are outlined on the attached Schedule 'A'. 2. By-Law No. 76-13, as amended, being the Comprehensive Zoning By-Law for the former Township of Bruce, is hereby further amended by deleting ~ the phrase "(and Ontario Hydro)" in the second sub-clause of Section 14.1.3 of the former Township of Bruce Comprehensive Zoning By-law adding the following Section 14.1.4 subsection 14.1 thereof: (i) Section 14.1.4 Within the area defined as the Bruce Nuclear Power Development 'BNPD' shown on Schedule 'A' to this By-law, all uses listed in Section 14.1.3 shall apply except that in lieu of the reference to 'Ontario Hydro', the following uses shall be permitted: · Electrical and heat energy plants · Electrical and heat energy transmission and distribution facilities · Ancillary facilities · Administrative offices, training and educational facilities and works as defined in the former Power Corporation Act · All buildings, structures and facilities with their associated uses existing on the BNPD site on the date of enactment of this By-law · Any additions, expansions or alterations to the buildings, structures and facilities provided the use of the BNPD does not change and provided such addition, expansion or alteration does not contravene any provisions of the Township of Bruce Comprehensive Zoning By-law 76-13. e e e e Amendment to Comprehensive Zoning By-Law 76-13 (Lots 11-30, Concession A, former Township of Bruce) By-Law No. 2001-23 Page 2 of2 (ii) All future development must comply with the requirements of the By-law. This By-law takes effect from the date of passage by Council and comes into force and effect pursuant to the provisions of the Planning Act, 1990. This By-law may be cited as the "Amendment to By-law 76-13 (Lots 11-30, Concession A, (former Township of Bruce)".
