A BY-LAW TO AMEND BY-LAW NO. 4.350 BEING THE RESTRICTED AREA BY-LAW FOR THE CORPORATION OF THE TOWN OF KINCARDINE WHEREAS the Municipal Council of the Corporation of the Town of Kincardine deems it adviseable to amend By-law No. 4.350 as hereinafter provided: 1) That Section 2.4. "Automotive Service Station" be deleted and replaced with the following: "2.4. - AUroIDTIVE SERVICE STATION shall mean a building or place, the prime function of which is the sale of auto- motive fuels and products and/or provid- ing repair service and maintenance to motor vehicles; but does not include an autobody repair shop." 2) That Section 2.16.15 "Split-level Dwelling" be deleted and replaced with the fóllowing: "2.16.15 - SPLIT-LEVEL IMELLING UNIT shall mean a building containing one or more dwelling units, in which the first floor above finished grade of each dwelling unit is so constructed as to create two or more different levels. These different levels of the first floor shall all be considered as part of the same storey except where the vertical distance between two different levels exceeds one metre; in which case, the two levels shall be considered as separate storeys." 3) That Section 2.2S "Home Occupation" be deleted and replaced with the following: "2.2S - HOME OCCUPATION shall mean a gainful occupation conducted Within a single detached dwelling house by the members of the family residing therein." 4.) That Section 4..9 "Home Occupation" be deleted and repalced with the following: "l¡..9 - HOME OCCUPATION A home occupation is a permitted use in a single detached dwelling subject to the following regulations: . - 2 - By-law 4460 . 1) Such home occupation is clearly secondary to the main residential use and does not change the residential character fo the dwelling house nor create or become a nuisance in regards to noise, traffic, and parking thereby interfenng with the use and enjoyment of the surrounding properties; 2) There shall be no visible indication that a home occupation is being carried on wi thin the dwelling house except that one sign no larger than 0.15m2 (1.6 sq. feet) attached flat to the face of the dwelling house shall be permitted and shall only show the name and occupation of the resident concerned; 3) There shall be no external storage of goods, materials or equipment nor shall there be any goods, services or merchandise offered or exposed externally for sale or rent on the premises; l¡.) Not more than 25 percent of the gross floor area shall be used for the home occupation (not to exceed 28m2) and no accessory building or other structure shall be used for such use; 5) There shall be no persons employed except in the case of a dentist, drugless practi- tioner, physician or veterinarian, in which case the staff shall be limited to one employee; and 6) Such home occupation may include: i) ii) iii) iv) an artist's studio dressmaking the consulting rooms of a medical practioner, lawyer, engineer teaching and musical instruction when limited to two pupils at a time å barber shop and a hairdressing shop a day nursery limited to 3 charges" v) vi) 5) That Section l¡..lO.l(i) be deleted. 6) That Section l¡..lO.l(ii) be deleted and replaced with the following: ._ - "(i) TOTAL FLOOR AREA OF BUILDING OR STRUCTURE NUMBER OF LOADING SPACES REQUIRED 7) less than l¡.,000.0 square metres That Section l¡..lO.l(iii) be renumbered l¡..lO.l(ii), and that Section l¡..lO(iv) be renumbered l¡..lO.l(iii). One" . 8) 9) That Section l¡..ll, entitled "Lots Undersized" be deleted. That Section 5.2.3 is amended by deleting this section in its entirety and replacing it with the following: - 3 ... By-law 4460 . "5.3.2 ZQNE REGULATIONS FOR SEMI-DETACHED IMELLINGS 1) When the two dwelling units in a semi-detached dwelling are both located on the same lot! the following lot area and lot width reguLations shall apply: Lot Area(Minimum) i) Interior Lot ii) Corner Lot Lot Width(Minimum) i) Interior Lot ii) Corner Lot 650.0 square metres 690.0 square metres 21.0 metres 22.5 metres 2) vlhen each of the two dwelling units in a semi- detached dwelling is to be located on a separate lot, the following lot are and lot width reg- ulations shall apply for each dwelling unit: Lot Area (Minimum) i) Interior Lot ii) Corner Lot Lot Width(Minimum) i) Interior Lot ii) Corner Lot 317.0 square metres 365.0 square metres 10.0 metres 11.5 metres 3) l¡.) 5) Front Yard(Minimum) 6.0 metres Exterior Side Yard(Minimum) 6.0 metres Interior Side Yard(Minimum) 24-0.0 centimetres provided that where a garage or carport is attached to the main building, the minimum width of the interior side yard shall be 120.0 centimetres plus 60.0 centimetres for each additional or partial storey above the first storey on that side. A semi-detached dwelling unit on a spearate lot shall require an interior or exterior side yard on only one side. 6) Rear Yard(Minimum) 7.5 metres 7) Buildin.e: Height (Minimum) 10.5 metres S) Coverage (Minimum) 45 percent 9) Dwellin.e: Unit Floor Area 67.0 square metres (Minimum) . 10) That Section 6.1.1, 6.2.1, 6.3.1, 6.3.2, and 6.3.l¡., be amended by replacing all referenced the "Automobile Service Station" to Automotive Service Station". 11) That Section' 6.1 be amended by adding the following subsection to the end of this section: . . """'II -l¡.- By-law 4460 "6.l.3 - Zone regulations for an automotive service station and a public garage. Refer to Section 6.3.2." l2} That Section 6.2 be amended by adding the following subsection to the end of this section: "6.2.3 - Zone regulations for an automotive service station and a public garage. Refer to Section 6.3.2" 13) That Section 6.4.l permitted uses for Local Commercial "C4", is amended be deleting; Dwelling units on the upper floor of a commercial Building". ll¡.) This By-law shall come into force and take effect upon final passing thereof by the Council of the Corporation of the Town of Kincardine subject to compliance with the provisions of The Planning Act (R.S.O. 1980), and amendments thereto.
