THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY-LAW
NO. 2001 -119
A BYLAW CONFIRMING THE ACQUISITION OF LAND FOR HIGHWAY
WIDENING PURPOSES AND ESTABLISHING THE SAME AS PART OF THE
PUBLIC HIGHWAY SYSTEM FOR THE MUNICIPALITY OF KINCARDINE
WHEREAS pursuant to the Municipal Act, R.S.O. 1990, chapter M.45, Section
191(1), the Council of every municipality may pass by-laws for acquiring land for
municipal purposes.
AND WHEREAS pursuant to the said Municipal Act, section 297(1) (b) the
Council of every municipality may pass by-laws for widening any highway or part
of a highway.
AND WHEREAS the Corporation of the Municipality of Kincardine has from time
to time acquired land for the purposes of widening and improving the existing
public highway system of the Municipality of Kincardine.
AND WHEREAS it is desirous to confirm the acquisition of the land as part of the
public highway system of the Municipality of Kincardine.
NOW THEREFORE the Council for The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That the acquisition of the lands described in the schedule attached to this
by-law is hereby confirmed and approved.
2. That the said lands described in the schedule "A" attached to this by-law
are hereby acquired for highway widening purposes and are accepted and
dedicated as part of the public highway system of the Municipality of
Kincardine.
3.
That this by-law shall become effective upon its final passage by the
Council of the Municipality of Kincardine and upon its registration in the
Registry Office for the Registry division of Bruce (No.3)
This by-law may be cited as the "Highway Dedication By-law (Block R
Registered Plan M-1, Ward 1)(Block 31 on 3M-102, Ward 2)(Block D on
M-44, Ward 3) and (Part 34 on Plan 3R-995 Ward 3)".

READ a FIRST, SECOND and THIRD time and DEEMED TO BE PASSED this
10th day of October, 2001.

Schedule "A"
Those lands and premises located in the following municipality, namely in the
Municipality of Kincardine, in the County of Bruce and being more particularly
described as follows:
Firstly:
Block R on a Plan of Survey deposited
as Plan M-1, (former Town of
Kincardine) now in the Municipality of
Kincardine;
Secondly: Block 31 on a Plan of Survey
deposited as Plan 3M-102, (former
Township of Kincardine) now in the
Municipality of Kincardine;
Thirdly: Block D on a Plan of Survey deposited
as Plan M-44, (former Village of
Tiverton) now in the Municipality of
Kincardine;
Fourthly: Part 34 on a Plan of Survey deposited
as Plan 3R-995, South half of Lot 5,
Concession 13, (former Township of
Bruce) now in the Municipality of
Kincardine.
