BEING A BY -LAW DESIGNATING CERTAIN LANDS WITHIN THE
MUNICIPALITY OF KINCARDINE, NOT TO BE A REGISTERED PLAN OF
SUBDIVISION

Municipality of Kincardine (geographic Township of Kincardine)
WHEREAS Section 50(4) of the Planning Act, R.S.O. 1990 authorizes the
Council of a Municipality to pass a by -law designating any Plan of Subdivision, or
part thereof, that has been registered for eight years or more, not to be a
registered Plan of Subdivision for the purposes of Subsection (3) of the Planning
Act;
AND WHEREAS certain lots described on Registered Plan of Subdivision 3M-
102 are within the geographic Township of Kincardine, Municipality of Kincardine;
AND WHEREAS the said Plan of Subdivision No. 3M -102 was registered in the
Registry Office for the Registry Division of the County of Bruce on the 31 day of
March, 1982;
• NOW THEREFORE the Council of the Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That the Registered Plan of Subdivision or parts thereof described in
Paragraph 2 of this by -law is hereby designated to be a Plan of Subdivision,
which shall be deemed not to be a Registered Plan of Subdivision for the
purposes of Subsection 3 of Section 50 of the Planning Act, R.S.O. 1990.
2. That the lands subject to this By -Law are described as PCL 15 -1 SEC 3M102;
Lot 15 Plan 3M -210, and PCL 25 -1 SEC 3M102; Blk 25 PL 3M -102, and PCL
16 -2 SEC 3M -102; Part Lot 16 Plan 3M102 Part 2 on 3R -3385, in the
geographic Township of Kincardine, in the Municipality of Kincardine.
3. That the Clerk of the Municipality of Kincardine shall cause a certified copy of
this By -Law to be lodged with the County of Bruce and to be registered in the
Land Registry Office for the County of Bruce as required by the said Planning
Act, Sections 50 (26) and (28).
• 4. That notice of the passing of this by -law shall be given within 30 days of the
passing thereof as required by the said Planning Act, Section 50 (29).

5. That the Council of the Municipality of Kincardine shall hear in person or by
• agent any person to whom a notice was sent and who within 20 days of the
mailing of the notice applies to be heard, respecting the Amendment or repeal
of this By -Law.
6. That this By -law may be cited as the "12 & 14 Dawson Drive Deeming By-
law".
