WHEREAS the Corporation of the Town of Kincardine has constructed and now operates and maintains a waterworks system. AND WHEREAS the Council of the said Town deems it expedient to make certain rules and regulations for the operation of the said waterworks system. Municipal Act R.S.O. 1980 c. 302 s. 219 THEREFORE the Council of the Corporation of the Town of Kincardine enacts as follows: 1. In this By-law: (a) "Corporation" shall mean the Corporation of the Town of Kincardine (b) "Utility" shall mean the Kincardine Public Utilities (c) "Manager" shall mean the Manager of the Public Utility for the Town of Kincardine (d) "Water Service Pipes" shall mean the water pipes which conduct potable water from Town watermains to water meters. (e) "Waterworks System" means the works and the equipment under the jurisdiciton of the Public Utilities for the supply or distribution of water or any part of such system (f) "Premises" means the property being supplied or to be supplied with water and includes the portion of a multiple occupancy premises separately supplied. (g) "User" includes, as the context requires, the applicant for water supply, the owner or occupant of and the person to whom invoices are sent for water supplied to the affected premises. 2. The waterworks system will be under the jurisdiction of the Manager. Meter reading and waterworks accounting shall be under the jurisdiction of the Treasurer of the Public Utilities. 3. No person except the Manager or those acting under his direction or authority shall open or close any valve in the waterworks system, or remove, tamper with or in any way interfere with any valve, water meter, hydrant, structure, main or water service pipes in the waterworks system. 4. No person shall in any way conceal or interfere with, or construct or maintain anything which has effect of concealing or interfering with access to a hydrant. . . - 2 - By-Law No. 4470 5. No person except the Chief of the Fire Department of the Town of Kincardine or the Manager or those acting under their discretion or authority, shall open or close a fire hydrant or use water from a fire hydrant in the waterworks system. 6. No person shall draw water from a private fire protection system except for fire protection purposes. 7. Water service pipes on public property between the watermain and the private property line shall be installed by the Utility 'at the cost of the applicant for such service pipes and at rates determined from time to time by the Utility. Water service pipes on private property shall be installed pursuant to a connecting permit previously being issued for such purpose by the Utility and at the cost of the applicant for such service. 8. Water service pipes located on private property shall be kept in good repair and working order by the user and in default the water supply thereto may be stopped. 9. Water service pipes on private property shall be of the same material as the water service pipes on public property to which they are connected. 10. All water service pipes shall be at least five feet below the finished ground grade and shall be properly protected from frost. 11. No person shall make any connection to any water service pipe without the written approval of the Manager. The user of service on premises on which an unlawful connection has been made shall be liable to pay the additional water rates and charges resulting therefrom, in addition to any other penalty provided. Application for the supply of water from the Town shall be made to the Department of the Public Utilities. 12. Except for water used for fire protection, any water supplied shall be metered and the user shall be invoiced by the Utility at rates established by the Utility from time to time. A flat rate unmetered charge for water to be used on building construction shall be made at the time of application for a new water service to provide water to the building during construciton. 13. The user of water supplied to a premises through a meter shall be liable to pay for all water passing through such meter. 14. Water meters shall be supplied and installed on notice by registered mail by the Utility at the cost of the property owner and at rates established from time to time by the Utility. The ownership of such water meter shall remain with the Utility. 15. The user of water service shall provide ready and convenient access to the meter so that it may be read and examined. 16. Where in the opinion of the Manager, a meter cannot be conveniently placed inside a premises it shall be placed in a meter chamber at a location and construction approved by the Manager and at the cost of the applicant. 17. The water supply to a premises may be stopped if the account . . - 3 - By-law No. 4470 for water supply is one month overdue. The cost of stopping and starting a water supply shall be added to the account payable and paid prior to again starting the water supply. 18. Except with the written approval of the Manager no person shall make any connections to any water service pipe so as to use water that has not passed through the meter. 19. Water supplied purusant to this By-law shall not be used otherwise than in connection with the premises for which it is supplied and shall not be sold or otherwise similarly disposed of. 20. If a meter fails to register properly, the user shall be liable to pay at the average consumption rate for a similar period as shown by the meter when it was in good operating order and if such period is not available, at the rate of the normal consumption for similar premises. 21. Any person using water without a meter where such water should be metered shall be liable to pay for water so used on the average consumption as shown by subsequent meter readings, or if no such readings are available, on the basis of the normal consumption for a similar premises. 22. At the request of the user and upon payment of the sum of $lO.OO a meter supplying water to the user and not exceeding 1 inch in diameter shall be removed and tested and if the test shows the meter is registering within a tolerance of three percent the said sum of ten dollars will be forfeited to the Utility. If such meter registers with a tolerance greater than three percent, the said sum shall be returned to the user paying the said monies and cost of removal, inspection and replacement shall be borne by the Utiltiy. 23. Similarly a meter exceeding 1 inch in size may be removed and tested and if the tolerance is within three percent the total cost of removal, inspection and replacement shall be added to the users water account and if over three percent at the cost of the Utility. 24. The user shall be liable to pay for repairs to any water meter damaged while in the users possession. 25. Utility approved backflow prevention devices shall be installed and maintained by the user at the user's cost in the water service pipe to any premises where water pipes connect to any water system in which chemicals are added or to any non- potable water system. 26. Where such backflow prevention devices are not installed or if installed are ,in the opinion of the Manager, not properly operative, the Manager may immediately order the public water supply to be stopped. . . - 4 - By-law No. 4.4.70 27. The Manager may temporarily discontinue the supply of water to any premises where, in his opinion, the continuation thereof might be dangerous or cause damage to persons or property, or if required to effect repairs to the waterworks system or any part thereof. 28. Every person who contravenes any of the provisions of this By-law is guilty of an offence and on conviction in accordance "with the Provincial Offences Act" 1979 is liable to a fine of not more that $100.00 exclusive of costs.
