HomeMy WebLinkAboutKIN 80 4278 Desig Ellenton Bldg THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW NO. 1.278 BEING A BY-LAW TO DESIGNATE THE COMMERCIAL BUILDING OF ROY A. ELLENTON AT 788 QUEEN STREET OF ARCHITECTURAL VALUE. . WHEREAS the Ontario Heritage Act, 1974 authorizes the Council of a municipality to enact By-laws to designate real property, including all the buildings and structures thereon, to be in historic or Architectural value or interest; and . WHEREAS the Council of The Corporation of the Town of Kincardine has caused to be served upon the owner of the lands and premises known as the commercial building of Roy A. Ellenton at 788 Queen Street upon the Ontario Heritage Foundation notice of intention to so designate the aforesaid real property and has caused such notice of intention to be published in a newspaper having a general circulation in the municipality once for each of three consecutive weeks; and WHEREAS the reasons for designation are set out in Schedule "B" hereto, and WHEREAS no notice of objection to the said proposed designation has been served upon the Clerk of the Municipality; THEREFORE, The Council of the Corporation of the Town of Kincardine ENACTS as follows: . 1. There is designated as being of architectural value or interest the real property more particularly described in Schedule "A" hereto, known as the commercial building of Roy A. Ellenton at 788 Queen Street. 2. The Town Solicitor is hereby authorized to cause a copy of this By-law to be registered against the property described in Schedule "A" hereto in the proper land registry office. 3. The Town Clerk is hereby authorized to cause a copy of this By-law to be served upon the owner of the aforesaid property and upon the Ontario Heritage Foundation and to cause notice of this By-law to be published in a newspaper having general circulation in the Town of Kincardine. ALL AND SINGULAR that certain parcel or tract of land and premises situate, lying and being in the Town of Kincardine in the County of Bruce and being composed of that part of Lot 3 on the west side of Queen Street in the said Town of Kincardine and more particularly described as follows: COMMENCING at a point in the east limit of said Lot 3 a distance of 16 feet 7 inches northerly of the south east angle of said Lot; THENCE Westerly and parallel with the southerly limit of said lot a distance of 60 feet; . THENCE Southerly and parallel with the easterly limit of said lot a distance of 7 feet 11 inches, THENCE Westerly and parallel with the southerly limit of said lot a distance of 23 fee't; THENCE Northerly and parallel with the eas'terly limit of said lot a distance of 7 feet 11 inches; THENCE Westerly and parallel with the southerly limit of said lot a distance of 141 feet to a point 40 feet easterly of the westerly limit of said lot; THENCE Northerly and parallel wi'th the easterly limit of said lot a dis'tance of 24 feet 8 inches more or less to the division line be- tween the north and south halves of said lot 3. THENCE Easterly and parallel with the southerly limit of said lot and being along the division line of the north and south halves of said lot a distance of 224 feet to the easterly limit of said lot; . THENCE Southerly along the said easterly limit a distance of 24 feet 8 inches more or less to the place of beginning. TOGETHER WITH A free and uninterrupted right-of-way, ingress and egress for persons, animals and vehicles through and along and over that part of said lot 3 on the west side of Queen Street in the said Town of Kincardine and more particularly described as follows: . COMMENCING at a point in the southerly limit of said lot 3 150 feet measured westerly thereon from the south-easterly angle of said lot; THENCE Westerly along the said southerly limit a distance of 10 feet; THENCE Northerly in a straight line parallel to the easterly limit of said lot a distance of 16 feet 7 inches to a point; THENCE Easterly in a straight line parallel to the southerly limit of said lot a distance of 10 feet to a point; THENCE Southerly parallel to the easterly limit of said lot a distance of 16 feet 7 inches to the point of commencement. BY-LAW NO. 1.278 SCHEDULE "A" CONTINUED AND SUBJECT TO right-of-way for all persons entitled thereto over that part of said lot 3 on the west side of Queen Street in the said Town of Kincardine more particularly described as follows: . COMMENCING at a point in the said lot 3 a distance of 150 feet measured perpendicularly from the easterly limit of said lot and at a distance of 16 feet 7 inches measured perpendicularly from the southerly limit of said lot 3; THENCE in a westerly direction parallel to the southerly limit of said lot a distance of 10 feet to a point; . THENCE in a Northerly direction parallel to the easterly limit of said lot to the point of intersection with the dividing line between the north and south halves of said lot; THENCE in an easterly direction along said dividing line a distance of 10 feet to a point; THENCE in a southerly direction parallel to the easterly limit of said lot to the point of commencement. . . BY-LAW NO. 1.278 SCHEDULE "B" . This Block was built in 1881 and is now in the ownership of three different businesses, however, the reasons for designation apply to the entire block. The subject property is a late 19th century commercial building located on the west side of Queen Street. . It is part of a predominantly two-storey commercial street facade and hence is an integral part of the overall street composition. This composition is characterized by a similar building height, brick as the predominant building material, a consistent pattern of vertically orientated second floor windows and an abundance of decorative cornice work. It is the second storey facade that is of particular merit and worthy of conservation and restoration. With regard to restoration of the subject property, as it is primarily the second floor exterior facade that is being conserved, it is encouraged that the second floor windows òf Gilbert's Jewellery and Ellenton's Home Hardware be replaced with windows of the ori- ginal pattern and proportion as above the Walsh property. . . ~
