WHEREAS the Ontario Herit<age Act, 1974 authorizes the Council of a municipality to enact By-laws to designaœ real property, including all the buildings and structures thereon, 1:;0 be in historic or Architectural value or interest; and . WHEREAS the Council of The Corporation of the Town of Kincardine has caused to be served upon the owner of the lands and premises known as the commercial building of David Walsh at 7S6 Queen Street upon the Ont<ario Herit<age Foundation notice of intention 1:;0 so designate the aforesaid real property and has caused such notice of inœnt.ion 1:;0 be published in a newspaper having a general circulat.ion in t.he municipality once for each of t.hree consecutive weeks; and WHEREAS t.he reasons for designation are set. out in Schedule "B" heret.o, and WHEREAS no not.ice of object.ion to t.he said proposed designat.ion has been served upon t.he Clerk of t.he Municipality; THEREFORE, The Council of The Corporat.ion of t.he Town of Kincardine ENACTS as follows: 1. There is designat.ed as being of archit.ect.ural value or interest the real property more part.icularly described in Schedule "AIt hereto, known as t.he commercial building of David Walsh at 7S6 Queen Street. 2. The Town Solicitor is hereby authorized to cause a copy of this By-law to be registered against. t.he property described in Schedule "An heret.o in the proper land registry office. . 3. The Town Clerk is hereby aut.horized to cause a copy of this By-law to be served upon t.he owner of the aforesaid propert<y and upon t.he Ont<ario Herit<age Foundat.ion and to cause notice of t.his By-law t.o be published in a newspaper having general circulation in the Town of Kincardine. . This Block was built in lSSl and is now in the ownership of three different businesses, however, the reasons for designation apply to t.he entire block. The subject. propert.y is a late 19th century commercial building locaœd on t.he west side of Queen Street. · It. is part. of a predominantly t.wo-storey commercial st.reet facade and hence is an integral part< of the overall street composition. This composition is characœrized by a similar building height, brick as the predominant building material, a consist.ent pat.tern of vertically orientated second floor windows and an abundance of decorat.ive cornice work. It is t.he second storey facade that. is of part.icular merit and worthy of conservation and restoration. With regard t.o rest.oration of the subject property, as it is primarily t.he second floor exterior facade t.hat is being conserved, it is encouraged that t.he second floor windows of Gilbert<'s Jewellery and Ellenton's Home Hardware be replaced with windows of the original patt.ern and proport.ion as above the Walsh property. · ·
