BY-LAW
No. 2004 - 89
BEING A BY-LAW TO AMEND ZONING BY-LAW 0.2003-25,
BEING THE COMPREHENSIVE ZONING BY-LÞ: FOR THE
MUNICIPALITY OF KINCARDINE

WHEREAS Section 34 of the Planning Act, R.S.O 1990, Char.r 13 authorizes the
. Councils of Municipalities to enact and amend zoning by-laws hich comply with an
approved official plan;
AND WHEREAS the Council of the Corporation of the Municipa ity of Kincardine has
enacted By-law 2003-25, a zoning by-law enacted under Se ion 34 of the said
Planning Act;
AND WHEREAS the Council of the Corporation of the Muni ipality of Kincardine
desires to amend By-law 2003·25;
NOW THEREFORE the Council of the Corporation of the Muni ipality of Kincardine
ENACTS as follows:
1. Schedule 'A' to By-law 2003-25 as amended, is hereby furt er amended by
changing thereon from 'I' to 'ACI-u' the zoning designation f those lands
described as Part Lot 5, Concession 7, Municipality of Kine rdine (former
Township of Bruce), which are outlined on the attached Sch dule 'A'.
Notwithstanding their 'ACI' zoning designation, those lands escribed as Part Lot
5, Concession 7, Municipality of Kincardine (former Townsh'p of Bruce) and
delineated as 'ACI-u' on Schedule 'A' to this By-law shall b used in accordance
with the 'ACI' zone excepting, however, that:

(i) The permitted non-residential uses shall be limited t :
a. Marine, Recreation and Small Engine Establi hment;
b. Offices accessory to a permitted use;
c. Rental Establishment;
d. Commercial Motor Vehicle Sales Establishm t;
e. Commercial Motor Vehicle Repair Establishm nt;
f. Commercial Motor Vehicle Storage;
g. Automobile Sales Establishment;
h. Recreational Vehicle Training School;
i. Food Processing, Primary; and
j. Veterinarian Clinic.
(ii) The minimum side yard setback shall be 3.0 m as it xists on the day of
passing of the By-law;
(iii) Off street parking requirements shall be in accordan with Section 6.20
of the By-law;
(iv) Off-street parking shall be permitted but no closer th t 15 metres to the
front lot line and 3.0 metres to a side lot line;

A Planting Area shall be provided consisting of a 3.0 m~re grassed
area/strip along the side and rear lot lines and a 15 met~e grassed strip
along the front lot line with the exception of areas reser..ted for parking and
driveways;
The lands shall be subject to Site Plan Control;
Commercial Motor Vehicle Storage shall mean a lot ~nd lor premises
for the storage of school buses and/or other commercia' motor vehicles;
and .
Recreational Vehicle Training School shall mean a 19t and/or building
or structure used for instruction in the use and operation of, and limited to,
motorcycles, snowmobiles and All Terrain Vehicles but ~hall not include
the use of such facilities for races or as a 'commercial use' by the general
public. .
3. This By-law takes effect from the date of passage by Council ~nd comes into
force and effect pursuant to the provisions of the Planning Ac~, R.S.O. 1990.
4. This By-law may be cited as the "Amendment to Comprehen~ive Zoning By-law
2003-25, (Part Lot 5, Concession 7, Municipality of Kincardim~ [former Township
of Bruce]), By-Law".
