THE CORPORATION OF THE TOWN OF KINCARDINE
BY-LAW NO.
4318
·
The Council of the Corporation of the Town of Kincardine in
accordance with the provisions of sections 13 and 17 of
The Planning Act, hereby enacts as follows:
·
1. Amendment No. 1 to the Official Plan of the Town of
Kincardine Planning Area, consisting of the attached
map designated Schedule "A" and explanatory test, is
hereby adopted.
2. That the Clerk is hereby authorized and directed to
make application to the Minister of Housing for approval
of Amendment No. 1 to the Official Plan of the Town
of Kincardine Planning Area.
3. This By-law shall come into force and take effect on the
day of the final passing thereof.

TO THE OFFICIAL PLAN FOR THE

This amendment to the Official Plan for the Town of
Kincardine Planning Area, which has been recommended
by the Town of Kincardine Planning Board and adopted
by the Council of the Corporation of the Town of
Kincardine is hereby approved in accordance with
section 17 of The Planning Act as Amendment No.1 to

the Official Plan for the Town of Kincardine Planning
Area.

the Council of the Town of Kincardine under the provisions
of sections 12 and 17 of The Planning Act, on the 23rd
day of September

Amendment.
PART B - THE AMENDMENT, consisting of the following text
and map (designated Schedule 'A') constitutes Amendment
No. ~ to the Official Plan of the Town of Kincardine
Planning Area.
Also attached is PART C - THE APPENDIX, which does not
constitute part of this amendment. Appendix I contains
details of the public involvement associated with this
amendment.

PART A - THE PREAMBLE
PURPOSE
The purpose of this amendment is to redesignate certain
lands within the Town of Kincardine, as shown on the attached
Schedule 'A', from 'Residential' to 'Highway Commercial'.
LOCATION
~his amendment applies to those lands located within the
north end of the Town of Kincardine, on the south side of
Broadway Street, east of Charles Street, and comprising
Lots 33 to 39 inclusive, Plan 4.
BASIS
The subject lands are currently occupied by two detached
dwellings ~nd comprise approximately 0.65 ha. Lands to the
north on the opposite side of Broadway Street, are developed
for various highway commercial uses. To the east and south,
the valley lands of the North Branch of the Penetangore
River are used for open space purposes while lands to the west
are developed for residential purposes.
With respect to land use, the development of the subject lands
under their current Residential designation could result in
up to seven individual detached dwell~ng units fronting onto
Broadway Street.

In this regard, it should be noted that as the subject lands
are located on the fringe of an existing residential
neighbourhood, direct access to the associated neighbourhood
facilities and its internal pedestrian and vehicular circular
system would be restricted due to the peripheral location of
these lands.
In addition, Broadway Street is designated as an arterial
roadway intended to handle the movement of large volumes of
vehicular traffic and provide limited access to abutting
properties. It is the intent of the Plan in this regard, to
provide for an efficient and safe transportation network and
to eliminate major traffic hazards. The possibility of
seven individual driveways in this location with direct
access to Broadway Street would not appear to contribute to
the realization of this objective¡ nor would the residential
development of the subject lands appear to be consistent with
the general policy of the Official Plan to buffer such
development from arterial roadways.
On the other hand, if the proposed redesignation of the
subject lands to Highway Commercial were approved, these
lands could be utilized for a highway oriented use(s)
dependent upon large volumes of vehicular traffic and
. therefore, requiring an arterial road location.
A Highway Commercial designation for the subject lands would
make it possible to develop these lands on a comprehensive,
rather than piece meal basis, with site plan controls and
with common access to Broadway Street thereby discouraging

unattractive strip development and minimizing danger to
vehicular and pedestrian traffic. Further, the current
policies of the Official Plan, relative to Highway Commercial
development, would ensure that the use of these lands is
highway oriented and does not compete on a functional basis
with the downtown or shopping centre commercial areas of
the Town thereby maintaining the economic viability of
these areas.

INTRODUCTORY STATEMENT
All of this part of the document entitled Part B - The
Amendment, consisting of the fOllowing text and attached
map designated Schedule 'A' constitutes Amendment No. -1L-
to the Official Plan of the Town of Kincardine Planning Area.
DETAILS OF THE AMENDMENT
Schedule 'A' of the Official Plan of the Town of Kincardine
Planning Area is hereby amended by redesignating from
'Residential' to 'Highway Commercial' the area outlined in
red on the attached Schedule 'A'.

No. ~, but is included as information supporting the
amendment.

APPENDIX I: PUBLIC PARTICIPATION
A public meeting was held by the Planning Board in the
'4IÞ Town Hall on September 23rd, , 1980. The purpose of
·
the meeting was to review the proposed Amendment prior to
its approval by the Planning Board and Council.
The meeting was advertised in the Kincardine News & Independent
,on September 10 &:'17;ï1980, and details of the proposed
Amendment were available for review at the Office of the
Clerk.
