BEING A BY-LAW TO AMEND ZONING BY·LAW NO 82..()8,
BEING THE COMPREHENSIVE ZONING BY-LAW F R THE
TOWNSHIP OF KINCARDINE I

Municipality of Kincardine (former Township of Kincard ne)
WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapter 13 aut orizes the Councils of
Municipalities to enact and amend zoning by-laws which comply with an approve official plan;
AND WHEREAS the Council of the Corporation of the Township of Kincardine h s enected By-law 82-08,
a zoning by-law enacted under Section 34 of the said Planning Act;
AND WHEREAS the Corporation of the Township of Kincardine has restructuret to now be a part of the
Corporation of the Municipality of Kincardine;
AND WHEREAS the Council of the Corporation of the Municipality of Kincardine desires to amend By-law
82-08;
NOW THEREFORE the Council of the Corporation of the Municipality of Kincard ne ENACTS as follows:
1. Schedule 'A' to By-law No. 82-08 as amended, is hereby further amend by changing thereon
from 'A1' to 'I', 'I' to 'A1' and 'A1' to 'A1-2004-66', the zoning designation of those lands described
as Part Lots 9 and 10, Concession 1 NOR, (being part of Parts 2 and 3 RP 3R-6082),
Municipality of Kincardine (former Township of Kincardine) which are ou lined on the attached
Schedule 'A'.
2. By-Law No. 82-08, as amended, being the Comprehensive Zoning By-L w for the Township of
Kincardine, is hereby further amended by adding the following paragrap s to Section 9.3 thereof:
9.3.50
Notwithstanding their 'A1' Zoning designation, those Ian s described as Part Lots
9 and 10, Concession 1 NOR, (being part of Parts 2 and 3 on RP 3R~082),
Municipality of Kincardine (former Township of Kinca ine), and delineated as
'A1-2004-66' on Schedule 'A' to this By-law may be us d for general agriculture
purposes in compliance with the 'A1' Zone provisions contained in this By-law,
excepting however, that:
(i) The minimum front yard setback shall be 15.0 ;
(ii) The minimum side yard setback shall be 10.0 .
3. This By-law takes effect from the date of passage by Council and come into force and effect
pursuant to the provisions of the Planning Act, R.S.O. 1990.
4. This By-law may be cited as the "Amendment to Comprehensive Zoning By-law 82-08, (Part Lots
9 and 10, Concession 1 NOR, (being part of Parts 2 and 3 on RP 3R-60 2), Municipality of
Kincardine (former Township of Kincardine», By-Law".
