HomeMy WebLinkAbout01 147 SD deem Lt 13 RP790 Brtw e e e e THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY-LAW NO. 2001 - 147 BEING A BY-LAW DESIGNATING CERTAIN LANDS WITHIN THE FORMER TOWNSHIP OF BRUCE, NOT TO BE A REGISTERED PLAN OF SUBDIVISION WHEREAS the Planning Act, R.S.O. 1990 c. P13, Section 50 (4) authorizes the Council of a Municipality to pass a By-law designating any Plan of Subdivision, or part thereof, that has been registered for eight years or more, not to be a registered Plan of Subdivision for the purposes of Subsection 50 (3) of the Planning Act; AND WHEREAS certain lots described on Registered Plan of Subdivision 790 are within the former Township of Bruce, Municipality of Kincardine; AND WHEREAS the said Plan of Subdivision No. 790 was registered in the Registry Office for the Registry Division of the County of Bruce on the 6th day of October, 1969; NOW THEREFORE the Council for The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That the Registered Plan of Subdivision or parts thereof described as follows is hereby designated to be a Plan of Subdivision which shall be deemed not to be a Registered Plan of Subdivision for the purposes of Subsection 3 of Section 50 of the Planning Act, R.S.O. 1990. 2. That the lands subject to this by-law are described as Lot 13, Registered Plan 790, (former Township of Bruce), Municipality of Kincardine, in the County of Bruce. 3. That the Clerk of the Municipality of Kincardine shall cause a certified copy of this by-law to be lodged in the office of the Minister and to be registered in the Land Registry Office for the County of Bruce as required by the said Planning Act, Sections 50 (26) and (28). 4. That notice of the passing of this by-law shall be given within 30 days of the passing, to the owners listed on the last revised assessment roll, as required by the said Planning Act, Section 50 (29). 5. That the Council of the Municipality of Kincardine shall hear in person or by agent any person to whom a notice was sent and who within 20 days of the mailing of the notice applies to be heard, respecting the Amendment or repeal of this by-law. .../2 e e e e By-Law No. 2001 - 147 Lot 13, Registered Plan 790 (Ward 3) Deeming By-law Page 2 of 2 6. This by-law shall come into full force and effect on its final passing. 7. This by-Jaw may be cited as the "Lot 13, Registered Plan 790 (Former Twp. of Bruce) Deeming By-law." READ a FIRST and SECOND time this 28"' day of November 2001. READ a THIRD time and DEEMED TO BE PASSED this 19th day of December, 2001.
