THE CORPORATION OF THE TOWN OF KINCARDINE
BY-LAW NO. 1..~¡;2

A By-law to authorize the stopping up of that portion of
Shevchenko Boulevard in The Town of Kincardine hereinafter described
and the conveyance of that part of said Street so stopped up to
Randall Arthur Smith and Priscilla Beth Smith, of the Town of Kincardine.
WHEREAS it is provided by Section 443 (1) (Cl) (d) of The
Municipal Act R.S.O. 1970 and amendments thereto, that the Council
of every Municipality may pass by-laws for stopping up a highway or
part of a highway and for leasing or selling the soil and freehold
of a stopped up highway or part of a highway.
AND WHEREAS Randall Arthur Smith and Priscilla Beth Smith applied
to the Council of the Town of Kincardine for the passing of a by-law
stopping up that part of said Shevchenko Boulevard in the Town of
Kincardine described in Schedule "A" to this by-law and authorizing
the selling of the soil and freehold of that part of Shevchenko
Boulevard so stopped up, to Randall Arthur Smith and Priscilla Beth
Smith of the Town of Kincardine.

AND WHEREAS notice of theintention of the said Council to pass
this by-law was published in four consecutive issues of the Kincardine
News, a newspaper of general circulation in The Town of Kincardine
which publications have been certified by the Clerk of the said Town
to the said Council.
AND WHEREAS no person who claims that his land will be prejudicially
affected by this by-law has applied to be heard.
AND WHEREAS the Council of the Corporation of the Town of Kincardine
has deemed it expedient to pass this by-law;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
KINCARDINE HEREBY ENACTS AS FOLL01¡lS:
1. That portion of Shevchenko Boulevard described in Schedule "A"
to this by-law shall be and the same is hereby stopped up.
2. The lands described in Schedule "A" hereto shall be
conveyed to Randall Arthur Smith and Priscilla Beth Smith
for the sum of ONE THOUSANDFIVE HUNDRED ($1500.00) DOLLARS.

3. The Mayor and the Clerk are hereby authorized to execute
a conveyance of the said lands in Schedule "A" hereto to
the said Randall Arthur Smith and Priscilla Beth Smith in
pursuance hereof and to affix to such conveyance the
Corporate Seal of the Corporation of the Town of Kincardine
and to do and execute all other things and documents
requisite and necessary to carry out the effect and intention
of this by-law. . .'

That By-law No. 4344 be and the same is hereby repealed.

SCHEDULE "A"
By-Law 4362
ALL AND SINGULAR that certain parcel or tract of land and premises
situate, lying and being in the Town of Kincardine, in the County of
Bruce and Province of Ontario and being composed of part of Shevchenko
Boulevard and part of Block "C" on Registered Plan 638, more
particularly described as follows:
COMMENCING at a point in the Northerly limit of the said Block "C"
which may be located as follows:
BEGINNING at the Southeast corner of Lot 12 as shown on the said Plan
638;
THENCE South 37 degrees 51 minutes 20 seconds East along the Northerly
limit of the said Block "C" 2.55 feet to the point of commencement
of the herein described parcel;
THENCE South 37 degrees 51 minutes 20 seconds East continuing along
the Northerly limit of the said Block "C" 49.02 feet to the beginning
of a curve;
THENCE Southeasterly along a curve to the left having a radius of 150.00
feet, an arc distance of 61.62 feet, the chord equivalent being 61.17
feet on a course of South 49 degrees 37 minutes 25 seconds East to a
point;
THENCE South 28 degrees 36 minutes 30 seconds West along the said
Easterly limit of Block "C" 66.00 feet to a point being the beginning
of a curve;
THENCE Northwesterly along the said Southerly limit of Block "C" being
a curve to the right having a radius of 216.00 feet, an arc distance
of 77.78 feet, the chord equivalent being 77.35 feet on a course of
North 51 degrees 04 minutes 35 seconds West to a point, said point
hereinafter referred to as Point "A";
THENCE Northwesterly along a curve to the left having a radius of 66.00
feet, an arc distance of 97.62 feet, the chord equivalent being 88.96
feet on a course of North 9 degrees 46 minutes 10 seconds East to the
point of commencement.
RESERVING UNTO the Grantor, its successors and assigns, an easement
and right s
(a) to enter, construct, maintain, inspect, alter, repair
and replace a water main including all appurtenances
thereto on and under the lands hereinafter described,
(b) for the servants, agents, contractors and workmen of
the Grantor to enter with machinery, materials, vehicles
and equipment necessary for the use of the easement,
the lands affected by this easement being part of said Shevchenko Blvd.
and part of said Block "C" more particularly described as follows:
COMMENCING at said Point "A";
THENCE Northwesterly on a curve to the left having a radius of 66.00
feet, an arc distance of 20.19 feet, the chord equivalent being 20.11
feet on a course North 43 degrees 22 minutes 57 seconds East to a
point;

THENCE Southeasterly on a curve to the left having a radius of
196.00 feet, an arc distance of 72.61 feet, the chord equivalent
being 72.20 feet on a course of South 50 degrees 46 minutes
38 seconds East to the interesection with the Easterly limit of
Block "C";

Easterly limit of Block "C" 20.00 feet to a point in the Southerly
limit of Block "C" being the beginning of a curve;
THENCE Northwesterly along the said Southerly limit of Block "C"
being a curve to the right having a radius of 216.00 feet, an
arc distance of 77.78 feet, the chord equivalent being 77.35 feet
on a course of North 51 degrees 04 minutes 35 seconds West to
the point of commencement.
