THE CORPORATION OF THE TOWN OF KINCARDINE
BY-LAW NO. 4377
Being a By-law respecting remuneration
and expenses for members of council and
local boards.

LEGISLATION: Section 389d of the Municipal Act as amended
R.S.O. 1970.
WHEREAS, pursuant to The Municipal Act, the council
of a municipality may by by-law provide for remuneration and
expenses for its members and for its appointees to local boards
and other bodies;

AND WHEREAS the said act provides for salary, expenses
and allowances paid by local boards to be established by the
council of a municipality;
NOW THEREFORE, the Council of the Corporation of the
Town of Kincardine ENACTS as follows:

INTERPRETATION
1. In this by-law and in the attached schedule the
following terms shall apply:
(a) "MUNICIPALITY" means the Corporation of the Town of
Kincardine.
(b) "COUNCIL" means the council of the Municipality.
(c) "LOCAL BOARD" means a local boards as defined in
The Municipal Affairs Act.
(d) "OTHER BODY" means any body other than a local board,
or the council of a municipality or a council
committee.
(e) "EX OFFICIO MEMBER" means and includes a member of a
local board or other body.
(i) who, by statute, is entitled to be a member of
that board or body by virtue of his office as
head of Councilor as a specified class of
Council member, or

(ii) who serves as a member of that board or body
pursuant to his appointment under section 213
of The Municipal Act.
(f) "COUNCIL COMMITTEE" means any standing or special com-
mittee, or subcommittee thereof, established by Council
regardless of the name by which it is identified or the
fact that persons other than Council members may be
included in its membership.

REMUNERATION
2. Council members shall receive remuneration as determined
according to the provisions of Schedule A appended to
and forming part of this by-law for their services as
Council members or officers of the Municipality.

3. (1)

Persons, whether Council members or otherwise,
appointed by the Council as members of a local
board or other body shall receive remuneration
as determined according to the provisions of
Schedule B appended to and forming part of this
by-law for their services as members of such board
or body.
(2)
In addition to the persons mentioned in subclause
1, a Council member who by virtue of his membership
on Council is an ex-officio member of a local
board or other body shall receive remuneration as
determined according to the provisions of
Schedule B for his services as a member of the
board or body.
For the purpose of this clause and Schedule B
"local board or other body" does not include a
public utilities commission or a hydro-electric
commission.
(3)
{I) The Municipal Treasurer shall, in accordance with
the provisions of Schedule D appended hereto and
forming part of this by-law, make payments to
(i) a Council member or a Municipal employee,
(ii)
a person appointed by the Council as a member
of a local board or a member of any other
body, or
an ex officio member of a local board, other
than a public utility commission (ancilor a
hydro-electric commission), or an ex officio
member of any other body,
in respect of expenses incurred by such person
that come within the appropriate description of
expenses in Schedule D.
(iii)
(2) For the purpose of this clause and Schedule D,
"Municipal Employee" means an officer, servant
or other employee of the Municipality, but does
not include:
(i) Any person who is a "council member" or who
received remuneration from the municipality
solely as a result of being a member of a
"local board" or "other body";
(ii) a volunteer fire fighter paid an honorarium,
allowance or salary for such services either
by the municipality or pursuant to a fire
protection agreement, provided such fire
fighter is not the fire chief;

Notwithstanding any other provision of this by-law,
where a person is entitled to receive remuneration or
expenses under this by-law from the Municipality in
respect of his membership on an "other body" in repect
of a certain period or certain items of expenditure
and where he has received or is entitled to receive
remuneration or expenses from that "other body" in
respect of the same period or for the same items
of expenditure, he shall deduct the remuneration and
expenses he has received from the other body or is
entitled to receive from the remuneration and expenses
that but for this clause would be payable to him under
this by-law in respect of his membership on the board
for that period and those items and the amounts
remaining, if any, shall be the amounts to which he is
entitled under this by-law as remuneration or expenses
for that period and those items.
The remuneration provided for in clauses 2 and 3 of
this by-law shall be paid by the treasurer of the
Municipality from the funds provided by Council and
the treasurer shall pay the said remuneration in
semi-annual installments.
Notwithstanding clause 6, where a person who has been
appointed by the Council as a member of a local board
or other body or an ex officio member of a local board
or other body fails to submit any information or
documentation required to be submitted in support of
a claim for remuneration or expenses, the treasurer
may pay such portion of the regular monthly instalment
as may be authorized without supporting documents and
the remainder shall be paid forthwith after such
necessary documentation is submitted.

(i)
Beginning in the year 1980, the Municipal treasurer
shall on or before the 28th of February in each
year submit to the Council an itemized statement
of the remuneration and expenses paid pursuant to
this by-law in the preceding year to:
(i) each member of Council in respect of his
services as a member of Councilor as an
officer of the Municipality in the preceding
year. ;
(ii) each person, whether a Còuncil member or
otherwise, appointed by the Council to a
local board orother body in respect of his
services as a member of the board or body
in the prece4ing year,
(iii) each ex officio member of a local board or
body in respect of his services as a member
or that board or body in the preceding year.
(2) The ~orm of the statement mentioned in subclause
1 shall be approved by the Municipal auditor and
the Council and the statement mey be subject to
audit.

9.
ìV'here the Municipal auditor determines that the
information contained in a statement submitted under
clause 10 appears to be in error, the error shall be
communicated to Council by letter to be dealt with at
its next regular meeting, and Council's disposition
of the matter shall be recorded in the minutes of the
meeting at which the letter is considered.
A statement submitted under clause 10 shall be in the
form set out in Schedule E appended to and forming
part of this by-law, but the treasurer may include
in the statement any additional information that he,
the Councilor the Municipal auditor sees fit.

The fee of $5.00 per meeting or $100.00 per year, whichever is
greater.

Remuneration of $50.00 per day for out-of-town meetings on municipal
business or attendance at conferences or seminars.
!~ALS: a maximum of $30.00 per diem with expense claims.
ACCOMMODATION: on submission of expense claim.
PARKING: on submission of expense claim.
I~LEAGE: the rate of .18¢ per kilometer. This schedule can be
amended from time to time by resolution of the Council
of the Town of Kincardine.
