NO. 2010 — 150
BEING A BY -LAW TO AMEND BY -LAW NO. 2006 — 107;
BEING A BY -LAW TO ESTABLISH STANDARDS FOR THE MAINTENANCE
OF PROPERTIES, BUILDINGS AND YARDS
IN THE MUNICIPALITY OF KINCARDINE
• WHEREAS Section 15.1 (3) of the Building Code Act, 1992, S.O. 1992, Ch. 23,
authorizes Councils of municipalities to pass by -laws prescribing standards for
the maintenance and occupancy of property within the municipality or within any
defined area or areas and for prohibiting the occupancy or use of such property
that does not conform with the standards and requiring property that does not
conform with the standards to be repaired and maintained to conform with the
standards or the site;
AND WHEREAS with the passage of By -law No. 2006 -107, the Council of The
Corporation of the Municipality of Kincardine established standards for the
maintenance of properties, buildings, and yards in the Municipality of Kincardine;
AND WHEREAS the Council of The Corporation of the Municipality of Kincardine
deems it necessary to amend Part IV — Vacant Lands and Buildings, Section
4.05 of By -law No. 2006 - 107;
NOW THEREFORE, the Council of The Corporation of the Municipality of
Kincardine ENACTS as follows:
• 1. That Part IV — 'Vacant Lands and Buildings' Section 4.05 of By -law No.
2006 — 107; the By -law established to set standards for the maintenance
of properties, buildings, and yards in the Municipality of Kincardine, be
hereby amended to read as follows:
The owner or agent of a vacant building shall board up the building
to the satisfaction of the Property Standards Officer by covering all
openings through which entry may be obtained with at least 12.7
mm (0.6 inch) weatherproof sheet plywood painted a colour
compatible with the surrounding walls and securely fastened.
a) Further to Section 4.05 - Buildings within the General
Commercial zoning shall repair and maintain window and door
glazing within a 60 day time frame.
2. This By -law shall come into full force and effect upon its final passage.
3. This By -law may be cited as the "Property Standards Amendment (2)
