NO. 2001 - 68
A BY-LAW TO AMEND ZONING BY-LAW NO. 82-08, BEING THE COMPREHENSIVE
ZONING BY-LAW FOR THE FORMER TOWNSHIP OF KINCARDINE (BRADLEY,
PART LOT 1, CONCESSION 11, PART 1 ON REGISTERED PLAN 3R-1599)
MUNICIPALITY OF KINCARDINE (FORMER TOWNSHIP OF KINCARDINE)
WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapter 13 authorizes the
Councils of Municipalities to enact and amend zoning by-laws which comply with an
approved official plan;
AND WHEREAS the Council of the Corporation of the Municipality of Kincardine has
enacted By-law 82-08, a Zoning By-law enacted under Section 34 of the said Planning
Act;
AND WHEREAS the Council of the Corporation of the Municipality of Kincardine
desires to amend By-law 82-08;
NOW THEREFORE the Council of the Corporation of the Municipality of Kincardine
ENACTS as follows:
1. Schedule 'A' to By-law No. 82-08 as amended, is hereby further amended by
changing thereon from 'C6' to 'M1-2001-68', the zoning designation of those lands
described as Part Lot 1, Concession 11, [Part 1 on Registered Plan 3R-1599],
Municipality of Kincardine (former Township of Kincardine) which are outlined on the
attached Schedule 'A'.
2. By-law No. 82-08, as amended, being the Comprehensive Zoning By-law for the
Township of Kincardine, is hereby further amended by adding paragraph 25.4.4 to
subsection 25.4 thereof:
(25.4.4) Notwithstanding their 'M1' zoning designation, the lands delineated as
'M1-2001-68' on Schedule 'A' to this By-law may be used for rural industrial purposes in
accordance with the 'M1' zone provisions contained in this by-law, excepting however
that:
(i)
The 'Non-Residential Uses' shall be limited to:
establishments for the fabrication, repair and servicing of agricultural
implements and equipment;
light industrial uses limited to: machine shop, welding shop, blacksmith
shop, wood fabricating operations;
establishments for the storage, grading and handling of seed, feed,
fertilizer and farm produce, together with a sales office for such products;
contractors yard;
building supply centre;
veterinarian clinic;
retail store;
stable;
open storage accessory to a permitted use;
retail outlet or a business office accessory to a permitted use;
sewage disposal system;
buildings, structures and uses accessory to a permitted use.

(ii) The 'minimum lot area (private services)' shall be no less than 2.2 hectares (5.4
acres).
(iii) All future development must comply with the requirements of the by-law.
3. This By-law takes effect from the date of passage by Council and comes into
force and effect pursuant to the provisions of the Planning Act, R.S.O. 1990.
4. This By-law may be cited as the "Amendment to By-law 82-08 (Part Lot 1,
Concession 11, Ward 2)".
READ a FIRST, SECOND and a THIRD time and DEEMED TO BE PASSED this
20th day of June 2001.
