" THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW NO. 4516 BEING A BY-LAW TO REGULATE THE PARKING OF VEHICLES ON PUBLIC STREETS IN THE TOWN OF KINCARDINE WITHIN CERTAIN HOURS. WHEREAS Section 315 paragraph 1 of the Municipal Act, R.S.O. 1980, Chapter 302, as amended authorizes the councils of local municipalities to pass by-laws "For prohibiting or regulating the obstructing, encumbering, injuring or fouling of highways or bridges; AND WHEREAS the Council of the Corporation of the Town of Kincardine deems it advisable to pass this by-law applicable to the whole of the Town; NOW THEREFORE be it and it is hereby ENACTED as follows: 1. For the purpose of this by-law the following definitions shall apply: "HIGHWAY" - includes a common and pUblic highway, street, avenue driveway, square, place, bridge, viaduct or trestle, designed and intended for, or used by, the general public for the passage of 'lehicles; "PARK OR PARKING" - when prohibited, means the standing of a vehicle, whether occupied or not, except when standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers; "VEHICLE" - includes a motor vehicle, trailer, tractor, engine, farm tractor, road - building machine and any vehicle drawn, propelled or driven by any kind of power, including muscular power, but does not include a motorized snow vehicle or the cars of electric or steam railways running only upon rails; 2. When properly worded signs have been erected and are on display, no person shall park and no owner of a vehicle shall permit to be parked a vehicle on any highway within the Town of Kincardine between the hours of 3:00 a.m. and 6:00 a.m. between the months of October 1 to April 30 inclusive. The only exception shall be Queen Street between Durham Market South and Broadway where no parking shall be permitted between the hours of 3:00 a.m. and 6:00 a.m. for the entire year. 3. This by-law shall apply to all vehicles except where compliance therewith appears to be impracticable and except to ambulances, fire and police department vehicles, emergency vehicles and doctor's cars. 4. The driver or the owner of any vehicle parked in contravention of this by-law shall be liable to a fine of $5.00 which shall be payable at the Clerk's office in the Town of Kincardine within 48 hours of the issuance of the ticket. 5. The Pólice Department of the Town of Kincardine have authority, in addition to any fee, charge or penalty herein before set out to remove any such vehicle in breach of this by-law from the highway at the expense of the owner thereof. 6. By-law No. 4112 be and the same is hereby repealed. 7. This by-law shall be effective upon its final passing.
