THE CORPORATION OF THE TOWN OF KINCARDINE
BY-LAW NO. 4520
.
Being a by-law to regulate the use of hoses,
sprinklers and soakers for lawn and garden
service with water supplied by the Public
Utilities Commission of the Town of
Kincardine.
WHEREAS the Public Utilities Commission of the Town of Kincardine
has requested the Council of the Corporation of the Town of
Kincardine to pass a by-law to regulate the use of hoses,
sprinklers and soakers for ~àwn and garden service with water
supplied by the Public Utilities Commission of the Town of Kincardine.
AND WHEREAS it is provided by Section 12 of the Public Utilities
Act R.S.O. 1980, Chapter 423, that the Corporation may pass by-
laws for regulating the time, manner, extent and nature of the
supply by the works, the building or persons to which and to whom
the water shall be furnished, the price to be paid therefor, and
every other matter or thing related to O~ connected therewith that
it may be necessary or proper to regulate, in order to secure to
the inhabitants of the municipality a continued and abundant
supply of pure and wholesome water.
NOW THEREFORE the Council of the Corporation of the Town of
Kincardine enacts as follows:
1. During the period from June 1 to October 1 in each and every
year that this By-law is in force, no owner, occupant, tenant,
firm or corporation shall use water for lawns or gardenS from
the service p~ovided by the Public Utilities Commission of the
Town of Kincardine, except:
(a) Property used for residential purposes in the area
west of Queen Street may be watered on the odd days of the
month between the hours of six o'clock and nine o'èlock in
the morning and six o'clock and ten o'clock in the evening;
(b) Property used for residential purposes in the area east
of Queen Street may be watered on the even days of the month
between the hours of six o'èlock and nine o'clock in the morning
and six o'clock and ten o'clock in the evening;
(c) Property used for commercial, industrial, institutional
and open-space purposes may be watered any day of the month
between the hours of nine o'clock in the morning and five
o'clock in the afternoon.
2. Anyone found in contravention of this By-law is guilty of
an offence and on conviction is liable to a fine of $20.00
for each offence.
3. By-law No. 2135, being a By-law to regulate the use of hoses,
sprinklers and soakers for lawn and garden service supplied
by the Public Utilities Commission of the Town of Kincardine.

hereby repealed.
