NO. 2010 - 102
BEING A BY -LAW TO DEDICATE A PORTION OF A ROAD ALLOWANCE AS
PART OF THE PUBLIC HIGHWAY SYSTEM FOR THE MUNICIPALITY OF
KINCARDINE
WHEREAS Section 31 (2) of the Municipal Act, 2001, S.O. 2001, c. 25, as
amended, provides that land may only become a highway by virtue of a by -law
establishing the highway;
AND WHEREAS it is necessary to change the ownership of the land from The
• Public Authority having Jurisdiction to The Corporation of the Municipality of
Kincardine;
AND WHEREAS the land affected is more particularly described as Part 8 on
Plan 3R -8366, Municipality of Kincardine, County of Bruce and consists of the
sidewalk portion of land along the east side of Penetangore Row;
AND WHEREAS it is desirous to dedicate the aforementioned land as part of the
Municipality's public highway system to allow legal status of fronting on, and
access to, a municipal road for the properties located along the east side of
Penetangore Row;
NOW THEREFORE the Council of The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. The Corporation of the Municipality of Kincardine does hereby establish
this land as a highway.
2. The ownership of this land be changed from The Public Authority having
Jurisdiction to The Corporation of the Municipality of Kincardine.
• 3. The said portion of highway shall be known as "Penetangore Row ".
4. That this by -law shall become effective upon its final passage by the
Council of the Municipality of Kincardine and upon its registration in the
Registry Office for the Registry division of Bruce (No. 3).
5. This by -law may be cited as the "Road Dedication (Penetangore Row)
By -law ".
