BY-LAW NO. 4526
A BY-LAW TO AMEND BY-LAW NO. 4350, AS
AMENDED, BEING THE RESTRICTED AREA
BY-LAW FOR THE CORPORATION OF THE TOWN
OF KINCARDINE
.
THE COUNCIL of the Corporation of the Town of Kincardine pursuant
to Section 39 of The Planning Act, R.S.O. 1980, as amended,
ENACTS as follows:
1.
By-Law
adding
12.19
No. 4350, as amended is hereby further amended by
the following Subsection 12.19 to Section 12 thereof:
Notwithstanding the provisions of the "Cl" Zone,
those lands delineated as Cl-l on Schedule "A"
t6this By-law, shall only be used in compliance
with the "Cl" Zone provisions contained in this
By-law, excepting however that:
1) dwelling units may be permitted on the upper
floors of a commercial building other than
an automobile service station or public
garage. For the purposes ,of this By-law,
the dwelling unit floor area requirements
of Subsection 5.4.2.8 shall apply to such
dwelling units.
2) the off-street parking requirements of
Subsection 4.12 shall not apply to
commercial uses. Off-street parking for
dwelling units shall be provided in accordance
with the apartment dwelling house requirements
of Subsection 4.12, excepting however that
no parking area, other than a driveway, shall
be located closer than 1.0 metres to any side
lot line.
2. Schedule "A" to By-Law No. 4350, as amended, is hereby
further amended by changing thereon from "Cl" to "Cl-l"
the zoning designation of those lands described as Part
of Lot 8, West Side of Queen Street, Registered Plan No.
61, in the Town of Kincardine, and shown outlined in the
heaviest black broken line on the attached Schedule "A"
to this By-law.
3. This By-law comes into force and effect on the final
passing thereof by the Council of the Corporation of the
Town of Kincardine subject to the provisions of The Planning
Act, R.S.O. 1980, and amendments thereto.

EXPLANATORY NOTE
RESTRICTED AREA BY-LAW NO. 4526 OF THE
CORPORATION OF THE TOWN OF KINCARDINE
Zoning By-law No. 4526 was passed pursuant to Section 39
of The Planning Act, R.S.O. 1980. It amends the Town's
Comprehensive Zoning By-law No. 4350.
The purpose of By-law No. 4526 is to re-zone a certain
parcel of land from "Cl" to "Cl-l".
The effect of By-law No. 4526 is as follows:
The 'Cl' GENERAL COMMERCIAL ZONE would permit a
wide range of commercial uses, in addition to
dwellings units existing at the date of passage
of By-law No. 4350, subject to certain minimum
requirements.
The 'Cl-l' GENERAL COMMERCIAL ZONE would permit
those commercial uses normally permitted by the
'Cl' Zone and dwellings units on the upper
floor of a commercial building. Commerical uses
permitted would be exempt from the parking
provisions of By-law No. 4350.
The lands affected by By-law No. 4526 are located in Part
of Lot 8, West Side of Queen Street, Registered Plan 61, in
the Town of Kincardine and are shown in more detail on the
attached Schedule 2(ii).

STATEMENT OF CONFORMITY TO THE OFFICIAL
PLAN FOR THE TOWN OF KINCARDINE PLANNING AREA

I, Charles Merritt, the Clerk of the Town of Kincardine
have reviewed By-law No. 4526 of the Town of Kincardine.
I am of the opinion that:
By-law No. 4526 is in conformity with the Official
Plan in effect for the Town of Kincardine Planning
Area.
