HomeMy WebLinkAboutKIN 83 4535 Amend Bylaw No.4350 . . BY-LAW NO. 4535 A BY-LAW TO AMEND BY-LAW NO. 4350, AS AMENDED, BEING THE RESTRICTED AREA BY-LAW FOR THE CORPORATION OF THE TOWN OF KINCARDINE. THE COUNCIL of the Corporation of the Town of Kincardine pursuant to Section 39 of the Planning Act, R.S.O. 1980, as amended, ENACTS as follows: 1. By-Law No. 4350, as amended, is hereby further amended, by deleting Subsection 12.14 of Section 12 thereof and replacing it with the following Subsection 12.14: 12.14 Notwithstanding the provisions of the R4 Zone, those lands zoned as R4-l on the Schedule 'A' to this by-law and comprised of Part One of Reference Plan 3R-3062 and Part of Lots 16, 17 and 18, North Side of Lambton Street, Plan 61 shall only be used in compliance with the R4 Zone provisions contained in this By-law, excepting however: (a) that a maximum of 4900 square feet (460 square metres) of Commercial Uses may be permitted on the lands described as Part One of Reference Plan 3R-3062. Such commercial uses shall be limited to the following uses: (1) a business or professional office or studio, (2) a clinic, (3) a financial office or institution, (4) a private educational facility, (5) a dressmaking or tailor shop, and (b) for the purpose of this Section the front lot line shall be deemed to be Princes Street. 2. Schedule "A" to By-law 4350, as amended, is hereby further amended by changing thereon from "R3-l" to "R4-l" the zoning designation of those lands described as Part One of Reference Plan 3R-3062 and Part of Lots 16, 17 and 18, North Side of Lambton Street, Plan 61, Town of Kincardine, and shown outlined in the heaviest black broken line on the attached Schedule "A" to the By-Law. 3. This By-Law comes into force and effect on the final passing thereon by the Council of the Corporation of the Town of Kincardine subject to the provisions of The Planning Act, R.S.O. 1980, and amendments thereto.
