HomeMy WebLinkAboutKIN 83 4539 Amend Bylaw No.4350 BY-LAW NO. 4539 A BY-LAW TO AMEND BY-LAW NO. 4350, AS AMENDED, BEING THE RESTRICTED AREA BY-LAW FOR THE CORPORATION OF THE TOWN OF KINCARDINE. . THE COUNCIL of the Corporation of the Town of Kincardine, pursuant to Section 39 of The Planning Act, R.S.O. 1980, as amended, ENACTS as follows: 1. By-law No. 4350, as amended, is hereby further amended by adding the following Subsection 12.20 to Section 12 thereof: 12.20 Notwithstanding the provisions of the Rl Zone, those lands zoned as "Rl-2" on the Schedule "A" to this By-law and comprised of Lot 6, West Side of Huron Terrace, Plan 4 shall only be used in compliance with the Rl Zone provisions contained in this By-law, excepting however, that a dance studio, health and fitness centre, and one accessory dwelling unit may be permitted within the existing building. Any accessory residential dwelling unit shall be used only as the principal residence of the owner, manager or caretaker and shall comply with the dwelling unit floor area requirements of Subsection 5.4.2.8. 2. Schedule "A" to By-law 4350, as amended, is hereby further amended by changing thereon from Rl to Rl-2 the Zoning designation of those lands described as Lot 6, West Side of Huron Terrace, Plan 4, Town of Kincardine, and shown outlined in the heaviest black broken line on the attached Schedule "A" to this By-law. 3. This By-law comes into force and effect on the final passing thereon by the Council of the Corporation of the Town of Kincardine subject to the provisions of The Planning Act, R.S.O. 1980, and amendments thereto.
