A BY-LAW TO AMEND BY-LAW NO. 4350, AS
AMENDED, BEING THE RESTRICTED AREA
BY-LAW FOR THE CORPORATION OF THE TOWN
OF KINCARDINE
THE COUNCIL of the Corporation of the Town of Kincardine pursuant
to Section 39 of The Planning Act, R.S.O. 1980, as amended,
ENACTS as follows:
1.
By-law No. 4350, as amended, is hereby further
amended by adding the following Subsection 12.20 to
Section 12 thereof:
12.21 Notwithstanding the provisions of the "Cl" Zone,
those lands delineated as Cl-2 on Schedule "A"
to this By-law, shall only be used in compliance
with the "Cl" Zone provisions contained in this
By-law, excepting however that:
1) dwelling units may be permitted on the
upper floors of a commercial building
other than an automobile service station
or public garage. For the purpose of
this By-law, the dwelling unit floor area
requirements of Subsection 5.4.2.8 shall
apply to such dwelling units.
2) the off-street parking requirements of
Subsection 4.12 shall not apply to commercial
uses. Off-street parking for dwelling
units shall be provided in accordance
with the apartment dwelling house
requirements of Subsection 4.12, excepting
however that each parking space shall be
an area of not less than 17.52 square metres,
having minimum dimensions of 2.92 metres
by 6 metres, exclusive of any aisles, or
ingress or egress lanes for the temporary
parking or storage of motor vehicles.

Schedule "A" to By-law No. 4350, as amended, is hereby
further amended by changing thereon from "Cl" to
"Cl-2" the zoning designation of those lands described
as Part of Lots 8 and 9, north side of Lambton Street
Plan 61, now Part 10 Reference Plan 3R-642, in the
Town of Kincardine, and shown outlined in the heaviest
black broken line on the attached Schedule "A" to
this by-law.

This by-law comes into force and effect on the final
passing thereof by the Council of the Corporation of
the Town of Kincardine subject to the provisions of
The Planning Act, R.S.O. 1980, and amendments thereto.
