THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY -LAW
NO. 2010 - 059
BEING A BY -LAW TO AMEND BY -LAW NO. 2009 -185;
BEING A BYLAW TO ESTABLISH RATES AND FEES FOR SERVICES
PERFORMED BY THE MUNICIPALITY OF KINCARDINE
WHEREAS Section 8 (1) and 9 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended,
provides that the powers of a municipality under this or any other Act shall be interpreted
broadly so as to confer broad authority on the municipality to enable the municipality to
govern its affairs as it considers appropriate and to enhance the municipality's ability to
respond to municipal issues and a municipality has the capacity, rights, powers and
privileges of a natural person for the purpose of exercising its authority under this or any
other Act;
AND WHEREAS Section 391 (1) of the said Municipal Act, authorizes a municipality to impose
fees or charges on persons, for services or activities provided or done by or on behalf of it;
AND WHEREAS the Council of The Corporation of the Municipality of Kincardine, with the
passage of By -Law No. 2009 -185, established rates and fees for services performed by the
Municipality;
AND WHEREAS the Council of The Corporation of the Municipality of Kincardine deems it
necessary to amend Schedules `B' and `E' of By -law No. 2009 — 185;
NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine
ENACTS as follows:
1. That Schedules `B' and `E' of the Municipality of Kincardine 2010 Consolidated Rates
and Fees By -law No. 2009 -185 are hereby repealed and replaced with the attached
Schedules.
2. That this by -law shall come into full force and effect upon its final passage.
3. That this By -law may be cited as the "2010 Consolidated Rates & Fees Amendment
(2) By -law ".
