HomeMy WebLinkAbout10 050 Amendment to Property Standards (Giant Hogweed) By-LawTHE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY -LAW No. 2010 - 050 BEING A BY -LAW TO AMEND BY -LAW NO. 2006-107; BEING A BY -LAW TO ESTABLISH STANDARDS FOR THE MAINTENANCE OF PROPERTIES, BUILDINGS AND YARDS IN THE MUNICIPALITY OF KINCARDINE WHEREAS Section 15.1 (3) of the Building Code Act, 1992, S.O. 1992, c. 23, authorizes Councils of municipalities to pass by -laws prescribing standards for the maintenance and occupancy of property within the municipality or within any defined area or areas and for prohibiting the occupancy or use of such property that does not conform with the standards and requiring property that does not conform with the standards to be repaired and maintained to conform with the standards or the site; AND WHEREAS with the passage of By -law No. 2006 -107, the Council of The Corporation of the Municipality of Kincardine, established standards for the maintenance of buildings, structures, yards and property within the municipality; AND WHEREAS the Council deems it necessary to amend Section 2.02 (3) of the said By -law to include giant hogweed; NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine ENACTS as follows: 1) That Section 2.02 (3) of By -law No. 2006 -107 be hereby amended to read as follows: (3) long grass (300mm), brush, undergrowth, giant hogweed and noxious weeds such as ragweed, poison ivy, poison oak, and poison sumac; as per the Weed Control Act. 2) This by -law shall come into full force and effect upon its final passage. 3) This by -law may be cited as the `Amendment to Property Standards (giant hogweed) By -law ".
