Home My WebLink About10 047 Removal from Development Agreement By-Law• • • • THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE KBT BY -LAW NO. 2010 — 047 BEING A BY -LAW TO REMOVE A DEVELOPMENT AGREEMENT FROM A PORTION OF LAND WITHIN THE MUNICIPALITY OF KINCARDINE WHEREAS the Planning Act, R.S.O. 1990, P.13, Section 41, authorizes municipalities to enter into Site Plan Agreements; AND WHEREAS the Council of the Municipality of Kincardine passed By -law No. 2007 — 272 authorizing a Site Plan Agreement with John Herman Roppel and Enbridge Ontario Wind Power LP, for that property located at Lot 11, Concession 5, Bruce, Part Lot 11 -13, Concession 6, Bruce as in R276599, R320292, Except Part 1 & 2 3R992, Part 1 3R5336; SIT BU13710; Municipality of Kincardine in the County of Bruce; AND WHEREAS Council deems it advisable to remove the said portion of land from the Development Agreement; NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That the lands described as East half Lot 3, Concession 12 (geographic Village of Tiverton), Municipality of Kincardine, County of Bruce, as shown in the attached Schedule `A', be removed from the Development Agreement authorized by Tiverton By -law No. 77 -003. 2. That the Mayor and Chief Administrative Officer be authorized and directed to sign and execute, on behalf of the Council of The Corporation of the Municipality of Kincardine, such documents as required for the removal from the Development Agreement for said lands; 3. This By -law shall come into full force and effect upon its final passage. 4. This By -law may be cited as the "Removal from Development Agreement (East half Lot 3, Con. 12) By -law."
