THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY -LAW
NO. 2010 - 044
BEING A BY -LAW TO AUTHORIZE THE SIGNING OF AGREEMENTS WITH
DR. JOHN ENGLE FOR AN INCENTIVE PACKAGE AND FOR THE RENTAL
OF COMMERCIAL OFFICE SPACE AT THE KINCARDINE COMMUNITY
MEDICAL CLINIC
WHEREAS subsection 107 (1) of the Municipal Act, 2001, S.O. 2001, c. 25, as
amended, provides that a municipality may make grants, on such terms as to
security and otherwise as the council considers appropriate, to any person, group
or body, including a fund, within or outside the boundaries of the municipality for
any purpose that council considers to be in the interests of the municipality;
AND WHEREAS pursuant to subsections 11 (1) and (2) of the said Municipal Act
a lower -tier municipality may provide any service or thing that the municipality
considers necessary or desirable for the public and may pass by -laws respecting
the health, safety and well -being of persons;
AND WHEREAS subsection 8 (1) of the said Municipal Act, provides that the
powers of a municipality under this or any other Act shall be interpreted broadly so
as to confer broad authority on the municipality to enable the municipality to
govern its affairs as it considers appropriate and to enhance the municipality's
ability to respond to municipal issues;
AND WHEREAS pursuant to Section 9 of the said Municipal Act a municipality
has the capacity, rights, powers and privileges of a natural person for the purpose
of exercising its authority under this or any other Act;
AND WHEREAS The Corporation of the Municipality of Kincardine requires
physicians to meet the needs of its residents;
AND WHEREAS the Council of The Corporation of the Municipality of Kincardine
deems it advisable to enter into two agreements with Dr. John Engle 1) for a
incentive package and 2) for rental space within the Kincardine Community
Medical Clinic;
NOW THEREFORE the Council of The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That The Corporation of the Municipality of Kincardine enter into an
incentive agreement with Dr. John Engle, attached hereto as Schedule `A'.
2. That The Corporation of the Municipality of Kincardine enter into a lease
agreement with Dr. John Engle for the rental of commercial office space at
the Kincardine Community Medical Clinic, 44 Queen Street, Municipality of
Kincardine, attached hereto as Schedule `B'.

3. That the Mayor and Chief Administrative Officer be authorized and directed
to sign and execute, on behalf of the Council of The Corporation of the
Municipality of Kincardine, the incentive agreement and the lease
agreement with Dr. John Engle attached hereto as Schedule `A' and
Schedule 'B' respectively, and to affix the corporate seal.
4. That Schedules `A" and `B' form a part of the By -law.
5. This by -law shall come into full force and effect upon its final passage.
6. This by -law may be cited as the "Engle Incentive & Lease Agreements
By -law ".
