HomeMy WebLinkAboutKIN 84 4607 Parking Meters CORPORATION OF THE TOWN OF KINCARDINE BY-LAW NO. 4.607 A BY-LAW TO REGULATE THE PARKING OF VEHICLES AND THE CONTROL AND USE OF PARKING METERS. . WHEREAS it is provi ded by the Munici pa 1 Act, R. S. O. 1980 Chapter 302, Section 315 (8) and Section 208 (55), a By-law may be passed by a Municipality to erect, maintain, operate Parking meters on any street, parts of streets, sides of streets and parking lots as defined in the By-law, and may further provide for penalties for the contravention thereof and for payment of said penalties. AND WHEREAS the Counci 1 of the CORPORATION OF THE TOWN OF KINCARDINE deems it advisable to enact such a by-law. NOW THEREFORE the Council of the Corporati on of the Town of Kincardine ENACTS as follows: 1 . That By-l aw Number 3120 passed on the 2nd day of October, 1975 of the Corporation of the Town of Kincardine be repealed. 2. DEFINITIONS For the purpose of this By-law: Driver includes the owner of a vehicle notwithstanding that he was not the driver of the vehicle at the time of contravention of the by-l aw. Park or parking, when prohibited, means the standing of a vehicle, whether occupieâ or not, except when standi ng temporari ly for the purpose of and while actually engaged in loading or unloading merch- andise or passengers. Parking Meter means a device that shall indicate thereon the length of tlme dunng which a vehicle may be parked which shall have as a part thereof a receptacle for receiving and storing coins, a lot or place in which such coins may be deposited, a timing mechanism to indicate the passage of the interval of time during tlhich the parking is permissable and which shall also display a signal when said interval of time shall have elapsed. parki ng Meter Zone means the streets or parts of streets or hi ghways designated by sUltable markings, the use of which is controlled and regulated by a parking meter. Street or Highway includes a common or public highway, street, avenue, parkway, drlveway, square, area, place, lot, bridge, viaduct, or trestle designed or intended for or used by the general publ ic for the passage of vehicles and shall include land owned or established by the Municipality for the parking of vehicles. Vehicle includes a motor vehicle, trailer, traction engine, farm tractor, road-building machine and any vehicle drawn, propelled or driven by any kind of power, including muscular power, but does not include a motorized snow vehicle, the cars of electric or steam railways running only upon rails. . 3. Parking Regulations While on duty, the driver of the following classes of vehicles, such vehicles having a sticker or plate issued by the Town Clerk affixed thereon, shall not be required to deposit coins in the parking meters provided for the parking space being occupied by such vehicle: ...2 By-law No. 4607 -2- 3. (a) Fire; (b) Police; (c) Ambulance; (d) Hearses; (e) Town of Kincardine vehicles; (f) Members of Council and Staff; (g) P.U.C. vehicles, Members of the Commission and Staff; (h) Any other vehicle so designated by a sticker or plate issued by the Town Clerk. 4. No driver of a vehicle shall park such vehicle in a parking meter zone unless the driver of such vehicle deposits in the parking meter provided for the parking space, the sum set forth. (i) In a fifteen minute limit zone established in accordance with this By-law the rate set out as indicated on the parking meter: 15 minutes for one 5¢ piece to maximum time on dial for convenience 15 minutes for one 10¢ piece for convenience 15 minutes for one 25¢ piece (ii) In a sixty minute limit zone established in accordance with this By-law the rate set out as indicated on the parking meter: 30 minutes for each 5¢ piece to maximum time on dial for convenience 60 minutes for one 10¢ piece for convenience 60 minutes for one 25¢ piece (i i i ) I n a one hundred and twenty mi nute 1 i mi t zone estab 1 i shed in accordance with this By-law the rate set out as indicated on the parking meter: 30 minutes for each 5¢ piece 60 minutes for each 10¢ piece to maximum time on dial for convenience 120 minutes for one 25¢ piece 5. No dri ver of a vehi c 1 e shall 1 eave parked such vehic 1 e in any parki ng space or part thereof when the parki ng meter for such space occupied indicates an expired time or violation flag in accordance with the time set out in this By-law, Schedule "A". 6. No driver of a vehicle shall allow such vehicle to remain parked for a longer period than that for which payment has been made in the form of coins deposited in the parking meter or meters, provided however, that thi s shall not prevent the dri ver of the vehi c 1 e from usi ng the unexpi red time remai ni ng in the meter from its previ ous use without depositing a coin therein. . 7. No dri ver of a vehi c 1 e shalla 11 ow such vehicle to remai n in a parking space for a longer period of time than: (i) 15 minutes at anyone time in a 15 minutes limit in accordance with this By-law No. 4607 .. .3 By-l aw No. 4607 -3- 7. (cont'd) (ii) 60 minutes at anyone time in a 60 minute limit zone in accordance wi th thi s By-l aw No. 4607 . (ii i) 120 minutes at anyone time in a 120 minute limit zone in accordance with this By-law No. 4607 8. No driver of a vehicle shall park such vehicle in a parallel parking space unless the front of such vehicle is alongside or as close as is practicable to the parking meter provided for such space in accordance with this By-law. (a) No driver of a vehicle shall park such vehicle in a parallel parking space unless the front or rear of such vehicle is alongside or as close as is practicable to the double meter provided for such space in accordance with this By-law. (b) No driver of a vehicle shall park such vehicle in an angle parking space of 45 degree, 60 degree, and or 90 degree unless the front end of the vehicle is nearest the parking meter provided for such space in accordance with this By-law. 9. No driver of a vehicle shall park such a vehicle in such a manner that it is not wholly within an area designated as a parking space, and if the vehicle is of such length as to prevent it from being parked within one parking space, then the person parking same shall make the necessary deposit of coins in the parking meter for the adjoining parking space. 10. No person shall deposit or cause to be deposited in any parking meter any slug device or other substitute for a 5¢ coin, 10¢ coin, or 25¢ coin of the Dominion of Canada or the United States of America. 11. It shall be the duty of Police officers assigned to the enforcement of this By-law to report: (a) the number and location of each parking meter which indicates that the vehicle occupying the parking space adjacent to such parking meter is or has been parked in violation of this By-l aw. (b) the complete permit number or any other identification tag marking, if any, of such vehicle. (c) the time during which such vehicle is parked in violation of any of the provisions of this By-law. (d) any other facts, the knowledge of which is necessary to a thorough understanding of the circumstances attending such violation. Each police officer shall also attach to such vehicle a serially-numbered notice to the driver thereof that such vehicle has been parked in violation of any of the prov- isions of this By-law and instructing the driver to report to the office of the Municipal Clerk in regard to such violation. . 12. It shall be the duty of the Chief of Police, or other person assigned by him for such purpose, to furnish to the Municipal Clerk a serially-numbered notice of violation as attached to any vehicle. ... 4 . . By-law No. 4607 - 4 - 13. Whereas the driver of a vehicle contravenes the prov~s~ons of this By-law, payment of the penalty in connection therewith may, within forty-eight hours of the time when such notice is attached to such vehicle, exclusive of Sundays and public holidays, be made to the Municipal Clerk or other designated official on duty at his office during normal office hours, 9:00 a.m. to 5:00 p.m., or deposit in courtesy boxes located on Queen Street, the sum of two dollars as a penalty for and in full satisfaction of such violation. Upon failure of such payment being made within the said forty-eight hours, exclusive of Sundays and public holidays, the driver of the vehicle shall become liable for prosecution as provided for in this By-law. 14. The Council from time to time shall authorize and assign stands on the highway and in public places for motor vehicles not kept for hire and also for motor vehicles and other vehicles kept for hire and for regulating the use thereof. 15. Any person or driver violating any of the prov~s~ons of this By-law shall be subject to a penalty of not more than twenty dollars for the first offence and not more than thirty dollars tor subsequent offence, exclusive of costs, and all such penalties shall be recoverable under the Summary Convictions Act. 16. The following streets or parts of streets are designated as parking meter zones in accordance with the CORPORATION OF THE TOWN OF KINCARDINE, By-law No. 4607, Schedule A, Column 1, 2 and 3. No driver shall park a vehicle on any of the streets or parking lots at the locations set out respective in Columns 1, 2, and 3, hereunder, during the times and days set out in Column 4, or for a longer period than that set out in Column 5.
