TOWN OF KINCARDINE
BY-LAW NO. 4609
.
WHEREAS it is provided by the Municipal Act R.S.0.,1980,
chapter 302, Paragraph 232 (]) that a by-law may be passed for
prohibiting or regulating and licensing exhibitions of wax works,
menageries, circus-riding and other like shows usually exhibited
by showmen, and for regulating and licensing roller skating rinks
and other places of like amusement, and merry-go-rounds, switchback
railways, carousels and other like contrivances.
AND WHEREAS the Council of The Corporation of the Town of
Kincardine deems it advisable to enact such a by-law;
NOW THEREFORE the Council of the Town of Kincardine
ENACTS as follows:
1. No person or persons or corporation shall hold or keep
for hire or profit in the Town of Kincardine, a menagerie, circus-
riding or other like show usually exhibited by showmen, and
merry-go-rounds, switch-back railways, carousels, and other like
contrivances, unless a licence therefor is first obtained from
the Town and the fee for such licence paid in full.
2. The licence fee shall be $40.00 for one day and for each
day thereafter an additional fee of $10.00 per day will be levied,
all fees to be paid at the time the licence is first obtained.
3. The Kincardine Agricultural Society will be exempt from
the licence fee for any show conducted and sponsored by the Society
in Connaught Park.
4. The Board of Management of the Business Improvement Area
will be expempt from this licence fee for any show conducted
and sponsored by the Board on the Lambton Towne Centre.
5. The Council of the Town of Kincardine may grant exemptions
from the licence fee for special events and such other special
events as it considers appropriate.
6. Every person or ~or¡roration who contravenes the provisions
of this by-law shall be subject to a penalty, such penalty being
the amount of the licence fees payable hereunder, exclusive of
costs, and all such penalties shall be recoverable under The
Provincial Offences Act, any penalty imposed hereunder may be
recovered by levying the same by distress and
sale of goods and chattels of the showman or proprietor, or
belonging to or used in such exhibition or show whether owned or
not owned by such showman or proprietor.
