HomeMy WebLinkAboutKIN 84 4617 Amend-Zone Christop T~E CORPORATION OF THE TOWN OF KINCARDINE BY-LAW NO. 4617 A BY-LAW TO AMEND BY-LAW NO. 4350, AS AMENDED, BEING THE COMPREHENSIVE ZONING BY-LAW FOR THE CORPORATION OF THE TOWN OF KINCARDINE. THE COUNCIL of the Corporation of the Town of Kincardine, pursuant to section 34 of The Planning Act, 1983, ENACTS as follows: . 1. By-Law No. 4350, as amended, being the Comprehensive Zoning By-Law for the Corporation of the Town of Kincardine, is hereby further amended by deleting Subsection 12.20 of Section 12 and replacing it with the following Subsection 12.20: 12.20 Notwithstanding the provisions of the 'R1' Zone, those lands designated by the zoning symbol 'R1-2' on the Schedule 'A' of this By-Law and comprising Lot 5 and Lot 6, West Side of Huron Terrace, plan 4 shall only be used in compliance with the 'R1' Zone provisions contained in this By-Law, excepting, however, that: (a) the uses permitted within the existing building may include one or more of the following uses: - a dance studio - a health and fitness centre - one accessory residential dwelling unit (b) the expansion and/or enlargement of the existing building may be permitted to accommodate racquet sports facilities and a lounge, provided that such expansion or enlargement: (i) is situated in the rear yard and/or side yard; (ii) provides a side yard along the northern extent of the side yard established by the existing building; and (iii) does not exceed a coverage greater than 10% of the combined lot areas of Lot 5 and Lot 6 (c) for the purposes of this paragraph the word "existing" shall mean existing on the date of passage of Zoning By-Law No. 4539 of the Corporation of the Town of Kincardine, being July 26, 1983. (d) any residential dwelling unit accessory to a permitted non-residential uses shall be used only as the principal residence of the owner, manager or care-taker and shall comply with the dwelling unit floor area requirements of Subsection 5.4.2.8. of this By-Law. 2. Schedule "A" to By-Law No. 4350, as ammended, is hereby further amended by changing thereon from R1 to R1-2 the Zoning designation of those lands described as Lot 5, West Side of Huron Terrace, Plan 4, Town of Kincardine, and which are shown outlined in the heaviest black broken line on the attached Schedule "A" to this By-Law. . 3. This By-Law takes effect from the date of passage by the Council of the Corporation of the Town of Kincardine pursuant to the provisions of The Planning Act, 1983.
