THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW NO. 4645 BEING A BY-LAW TO AUTHORIZE THE MUNICIPALITY TO ENTER INTO AN AGREEMENT WITH JOHN BRIAN RADIGAN TO SET OUT THE TERMS AND CONDITIONS OF HIS EMPLOYMENT WITH THE TOWN OF KINCARDINE AS THE ECONOMIC DEVELOPMENT COMMISSIONER. WHEREAS the council of the Corporation of the Town of Kincardine deems it expedient to enter into an agreement with John Brian Radigan to set out the terms and conditions of his employment with the Town of Kincardine. NOW THEREFORE the council of the Corporation of the Town of Kincardine ENACTS as follows: 1. That the mayor and clerk be and are hereby authorized to sign an agreement with John Brian Radigan to set out the terms and conditions of his employment as the economic development commissioner for the Corporation of the Town of Kincardine. 2. That this By-law shall be effective on the final date of its passing. AND WH~REAS John Brian Radigan has been appointed to the position of economic development commissioner pursuant to By-law 4q44. AND WHEREAS ~y~law 4644 provides that the appointment to the position of economic development commissioner shall be subject to an appointment between John Brian Radigan and the Town. WITNESSETH AS FOLLOWS: The Town hereby hires John Brian Radigan to be the economic development commissioner for the Town upon the following terms and conditions and in accordance with By-law 4644 of the TOwn, which John Brian Radigan hereby accepts, namely: 1. The term of employment will be for three years from the date hereof, subject to earlier termination as hereinafter provided. 2. Thè gross salary Öf.John Brian Radigan for the first and second years of employment shall be in accordance with By-law 4578, Schedule "C", grade scale "Q". For the second year of ,employment~; the gross salary of John Brian Radigan will not ~be less than increment ·4tS of the aforementioned grade scale "Q". The grOScssalary of John Brian Radigan for the third yea'lf/( femployment shall be established by negotiations and in any· event there;shall be no reduction in gross salary unless otherwise agreed to by the Parties hereto. If a salary for ·fo'f' the third year cannot be successfully negotiated,such . failure. to reach ·å.greement on a salary shall be grounds for termination of this agreement. ... .2 J , t ~.x - 2 - 3. John Brian Radigan shall devote his whole working time and attention to the employment during the term thereof-and shall not engage in any other business or occupation during the term of employment. 4; John Brian Radigan shall not, either during the term of his employment or at any time thereafter, disclose to any person, firm or corporation any information concerning the business or affairs of the Town which John Brian Radigan may have acquired in the course of or incidental to his employment hereunder or otherwise, whether for his own benefit, or to . the detriment, or intended or probable detriment, of the Town. ~. 5. The a) b) c) d) e) f) g) h) following benefits of employment shall apply: canada Pension Plan (employer share only); Unemployment Insurance (employer share only); Worker's Compensation coverage; E~rollment in the Ontario Municipal Employee's Retirement System; Two weeks vacation for each full year of service; Paid holidays as per Section 11, Schedule "A" of By-law 4265; Compassio1'\ate leave as per Section 13, Schedule "A" of . By-law 4265; ~enty-one (21) days of sick leave per annum at 100 per cent (100%) of salary. Unused sick leave may be accumulated but there is no payment of unused sick leave upon terminat;ion of employment. i) Group insurance will apply. The Town will pay 50% of the premium on the dental plan and 100% of the premium on the rest of the plan. The group insurance plan shall be the same âs is available to the Town's full time employees. 6. The Town may terminate this agreement at any time with one week's notice by reason of the employee's violation of instructions or rules of the Town, or failure to comply with any agreement on the part of John Brian Radigan as herein set out. Any such action may only be taken after a hearing by the council or a committee of the whole council if requested by John Brian Radigan. His salary has been negotiated as follows: His salary for the first year of employment shall be $35,000. and graded as grade 1/2 on range Q, Schedule "C" of By-law 4578. His second year salary will also be according to range "Q" of the same schedule. However, the salary will be open for negotiation and shall not be less than $37,500 and not more than $40,000. His third year salary is open for negotiation and shall not be less than his second year salary unless agreed to by both parties. I trust Council will accept this recommendation. ------ .-._---. -
