THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW NO. 1,.(,<;5 BEING A BY-LAW TO AUTHORIZE AN EXPANSION TO THE EXISTING WATER DISTRIBUTION SYSTEM AND THE BORROWING OF $420,000.00 UPON DEBENTURES. WHEREAS the Council of the Town of Kincardine has deemed it necessary to authorize an expansion to the existing water distribution system consisting of th3 construction of one (1) 10.50m diameter x 41.80m high, 3500m capacity water standpipe and other related equipment at an extimated cost of $736,000.00. AND WHEREAS pursuant to paragraph 51 of Section 210, chapter 302 of the Municipal Act. By-laws may be passed by the Councils of local Municipalities for authorizing the work hereinafter set forth; AND WHEREAS the Council of the Corporation of the Town of Kincardine by a vote of an affirmative vote of at least three- forths of all members of Council; ENACTS as follows: 1. In this By-law "work" shall mean the expansion to the existing water distribution system consisting of the 50nstructing of one (1) 10.50m diameter x 41.80m high, 3500m capacity water standpipe and other related equipment at an estimated cost of $736,000.00. 2. The undertaking of the said work, the extension of the powers of the Corporation of the Town to proceed therewith, and the provision of monies therefor by the issue of debentures in an amount not exceeding $736,000.00 less payment of $158,000.00 from the Province of Ontario under the Ontario Neighborhood Improvement Plan and less payment $158,000.00 from the W~~e~ Reserve Fund and repayable in 20 years is hereby approved and authorized. 3. The Treasurer of the said Corporation may, subject to the approval of Council, agree with any bank or person for temp- orary advances of money to meet the costs of the work pending the completion thereof. 4. B.M. Ross & Associates Limited be appointed as Engineer and they do furtherwith make such plans, profiles and specifications and furnish such information as may be necessary for the making of a contract for the execution of the work. 5. The work shall be carried on and executed under the supervision of and according to the directions and orders of the Engineer. 6. In each year in which an instalment of the said debentures becomes due, the amount to be paid shall be paid from the income of the P.U.C. until the debenture has been paid in full. 7. This By-law shall not come into force and effect until the approval of the Ontario Municipal Board has been obtained pursuant to Section 64 of the Ontario Municipal Board Act and shall come into force and effect upon such approval being given. SCHEDULE "A" BY-LAW NO. 4655 Expansion to the existing water distribution system servinejp1¡:he Town of Kincardine consisting of the following; - construction of one (1) 10.50 M diameter x 41J.8M high, 3500 M3capacity water standpipe to be located approx- imately 45M northwest of Hamlin Street and approximately 130M southwest of Broadway (east) (former Highway No.9); - construction of one (1) 8.40M long x 7.40M wide x 2.80M high booster pumping station; installation of one (1) fire pump capable of pumping 100 Lis against 16.2M TDH; installation of one (1) 80KW diesel generator serving the above pumping station; Street Watermains Easement From To Durham St. approx. 25M E. of Walsh St. approx. 220M N. of Durham St. Together with all interconnecting piping, associated valves, appurtenances, lighting, heating, electrical and control systems, all in accordance with the preliminary design brief, calculations and drawings prepared by B. M.
