A BY-LAW TO AUTHORIZE CERTAIN PARKING, STANDING & STOPPING OF VEHICLES OPERATED BY, OR CARRYING PHYSICALLY HANDICAPPED PERSONS, AND THE ISSUING OF PERMITS IN RESPECT THEREOF. WHEREAS Section 210(119) and Section 210(150) of the Municipal Act, R.S.O. 1980 C. 302 as amended enable Council to enact such bylaws; AND WHEREAS it is in the interest of Council to enact such a by-law; THEREFORE the Council of the Corporation of the Town of Kincardine ENACTS as follows: 1. In this By-law: (a) "DesigRated.J?arkiRg.Space" means a parking space (spaces) designated tor the sole use of vehicles on which a permit is properly displayed, and such space is identified by a sign bearing ~he markings and having the dimensions as shown in Schedule "A" to this By-law. :(b) i) "l'ermit" means a permit issued under this by-law to a physically handicapped person, or a permit issued for the pu~poses of By-laws passed under Section 210(119) or 210(150) of the Municipal Act. (ii) "Markers"-or-"Devices" issued by other jurisdictions for the purpose ot indentitying handicapped persons or vehicles owned by handicapped persons shall be deemed to be a permit. (iii) a number plate issued under the Highway Traffic Act that bears the symbol for the disabledcshallbe deemed to be a permit. (c) "J?hysic;:a11y-]; andd;c;:apped.Person" means (i) A person who is physically handicapped in such a way that his or her mobility is seriously restricted including, among others, a person who uses a wheelchair, crutches, braces or other mobility assisting devices, or (d) (it) A person who is qualified to ho,ld and'idoes, ho'ld a permit issued by another municipality in Ontario. "On-Street· Parking" refers to parking on any highway or road or part tnereof in the Corporation. (e) "On· Street-Parking" refers to parking lots or other parking facilities to which the general public has access, whether on payment of a fee or otherwise. (f) . (g) "Park.Qr.Parking" when prohibited, means the standing of a vehicle, wnether occupied or not, except when standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers. "StanctQr-Stancting" when prohibited means the halting of a vehicle, whether occupied or not, except for the purpose of and while actually engaged in receiving or discharging passengers. ." (h) "Sto~ or Standin~" when prohibited, means the ha1t~ng of a veh~cle, even momentarily,. whether occupied or not, except when necessary to avoid conflict in compliance with the directions of a police officer or a traffic control sign or signal. 2. The Clerk of the Town of Kincardine is hereby authorized to issue permits to physically handicapped persons or to a person who owns, leases or operates a motorized vehicle for transportation of a physically handicapped person. 3. A permit issued under this By-law shall remain valid for a period not exceeding five years from the date of issue unless earlier revoked. 4. Permits issued under this By-law are not transferable and no person, other than a physically handicapped person, shall acquire or use a permit. 5. A permit shall be used by displaying it, - (a) affixed to the right-hand inside of the wind- shield; or (b) on the passenger's side of the dashboard of the vehicle in such a manner, that it is readily visible from the outside of the vehicle. 6. No person shall use a permit other than in the manner provided for in this'By-law and if any unauthorized use is made of the permit, the Clerk of the Town of Kincardine shall have the authority to revoke the permit. 7; The areas set out in Schedule "!." annexed hereto and forming part of this By-law are designated as designated parking spaces. 8. A permit used any parking area in Schedule "A". under this By-law shall not be in force at other than those specifically designated 9. Any person violating any of the provisions of this By-law shall be subject to a penalty of not more than $10.00 for the first offence and not more than $50.00 for every subsequent offence, exclusive of costs, and all such penalties shall be recoverable under The provincial Offences Act. 10. This By-law shall come into force and take effect on the final reading thereof.
