HomeMy WebLinkAboutKIN 85 4668 Amend Bylaw No.4350 THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW NO. 4668 A BY-LAW TO AMEND BY-LAW NO. 4350 AS AMENDED, BEING THE COMPREHENSIVE ZONING BY-LAW FOR THE CORPORATION OF THE TOWN OF KINCARDINE. . 1. By-law No. 4350 as amended, being the Comprehensive Zoning By-Law for the Corporation of the Town of Kincardine, is hereby further amended by adding the following Subsection 5 to Section 5 thereof: 5.5 Residential Five Zone "R5" 5.5.1 Permitted Uses A Nursing Home and uses accessory thereto. 5.5.2- Zone Regulations for a Nursing Home 1) Lot Area (Minimum) 10,000m2 2) Lot Width (Minimum) 30 metres 3) Front Yard (Minimum) 6 metres 4) Exterior Side Yard (Minimum) 6 metres 5) Interior Side Yard (Minimum) 6 metres 6) Rear Yard (Minimum) 6 metres 71 Number of Storeys (Maximum) 1 8) Coverage (Maximum) 40% 9) The Loading Space Requirements of Section 4.10 shall apply to the uses permitted within the 'R5' Zone; 10) The Off-Street Parking requirements of Section 4.12 shall apply excepting how- ever that, a Nursing Home shall provide 1 space per two (2) patient beds or fraction thereof, of which a minimum of two (2) parking spaces, each with minimum area of 21.6 square metres and minimum dimensions of 3.6 metres by 6.0 metres shall be provided for the parking of passenger vehicles used in the transport- ation of wheelchair users and the ambulant disabled; 11) Planting Strips shall be provided in accordance with Section 4.13 along the northerly and easterly lot lines where such lot lines abut a Residential or Development Zone. 2. By-Law No. 4350 as amended, is hereby further amended by adding the following Subsection 12.22 to Section 12 thereof: . 12.22 Notwithstanding their 'Rl' Zoning designation, those lands described as Part of Park Lot 5 and Part of Park Lot 6, East of Park Street, . . . . . .. 2 Page 2 By-Law No. 4668 2. (cont'd) . 12.22 (cont'd) Registered Plan No. 61 and identified by the zone symbol 'Rl-4' on Schedule "A" of this By-Law shall only be used in compliance with the 'Rl' Zone provisions contained in this By-Law excepting, however, that: (i) the minimum lot area and the minimum lot width shall be 7000 square metres and 60.0 metres respectively. (ii) no vehicular access shall be permitted directly to or from the Russell Street road allow- ance. 3. Schedule "A" of By-law No. 4350 as amended, is hereby further amended by changing thereon from "D" and "Rl" to "R5" and "Rl-4", the zoning designations of those lands described as Part of Park Lot 5 and Part of Park Lot 6, East of Park Street, Registered Plan No. 61 and which are shown outlined by the heaviest black broken line on the attached Schedule "A". 4. This By-Law takes effect from the date of passage by Council and comes into force pursuant to the provis- ions of The Planning Act, 1983.
