! A -By -Law to provide for a drainage works in the Township
,of Kincardine in the County of Bruce.
WHEREAS the 'requiaite_number of owners have'petitioned the
council of the Corporation of the Township of Kincardine in
the County of Bruce in accordance with the,provisions of The
Drainage Act, 1975 requesting that certain lands and roads be
drained by a drainage works.
AND WHEREAS the council of the Corporation.of the of
Kincardine in the County of Druce,bas a report made

AND WHEREAS the.council is .of the' opinion that the drainage 'of
the area is desirable.
THEREFORE the council of' the 'Corporation of the Township of
Kincardine pursuant to The' Drainage,Act,,1975,, enacts as follows:
'(1) "The report is hereby adopted and.the- drainage
works as therein indicated and set forth is hereby
authorized and shall be completed in accordance
herewith.
(2)C: The amount assessed against all lands and 'roads, '
Sfter'being reduced by the grants available, shall
become due, and payable upon completion of the drain
and shall be levied and collected in the same manner
as other taxes are levied and collected and shall
be subject to the same penalties and rates of
interest.
(3) This By -law comes into force on the, passing'thereof;
and may, be cited : .as "Norman Mat:Arthu_(Nuntrjsitt By -Law ".

1.0 PRELIMINARY REPORT - SUMMARY
On June 1, 1981, Paragon Engineering
Limited was appointed by Council to prepare a Preliminary Report in
accordance with Section 10 for a new municipal drain to be known as
the Norman MacArthur Municipal Drain. The appointment was the result
of a petition signed by landowners in an area described as requiring
drainage.
In accordance with Section 9 of the
Drainage Act, 1975, a site meeting was held at which it was determined
that the area requiring drainage included:
Parts of Lots 9 to 13, Concession VIII
Parts of Lots 9 to 14, Concession IX
of the Township of Kincardine. It was also determined that the petition
complied with Section 4.
The Preliminary Report was prepared and
filed with the Township of Kincardine on August 27, 1981. Copies of
the report were sent to every landowner within the area requiring drainage
and to all affected public utilities. On September 17, 1981, a Council
meeting was held at which time the Preliminary Report was considered. At
the end of the subject meeting, Council gave notice to Paragon Engineering
Limited to prepare a final report.
Details of the present conditions and
proposed work, which were outlined in the Preliminary Report, are
presented in this report in Sections 2.0 and 3.0 respectively.
2,0 PRESENT CONDITIONS
The area now petitioned for drainage
works is smooth and gently sloping from east to west. The average
slope of the drainage basin is approximately 0.85 percent. The
majority of the drainage area is in agricultural use. The main crops
are corn, mixed grains and pasture. The full potential of the land
is not possible due to the absence of an adequate drainage outlet for
surface water and tile drainage.
We find that the drainage area comprises
approximately 136 hectares (336 acres).
Our investigation determined that there
is an existing drainage system in the subject area which is known as
the Sam. Lindsay Award Drain No. 1. Exact details of the drain are
not available, however, information gathered during the site visit and
subsequent field survey indicate that the Award Drain is located
approximately in the same location as the proposed Main Drain of the
Norman MacArthur Municipal Drain. The Award Drain is reported to range
in size from 178 mm (7 inches) to 254 mm (10 inches) in diameter. Due
to the deterioration of the Award Drain and its limited capacity as
related to the area which it services, its benefit to the farmers
within the drainage basin is limited.
3.0 PROPOSED WORK
To improve the drainage, a closed
drainage system with catchbasins to collect surface water is proposed.
The new drain has been designed to accommodate the runoff from the
watershed and will have sufficient depth to enable the Award Drain to
be connected, if deemed desirable by the Engineer during construction,
and to take care of any drainage that the old drainage works is carrying.

3.1 MAIN DRAIN
The drainage work is divided into three
The Main Drain is 2077 metres (6813 feet)
in length and receives the runoff from approximately 99.6 hectares
(246 acres).
The drain crosses the 9th Concession Road
at two locations and the 10th Sideroad once.
The outlet for the municipal drain is at
the south -west corner of Lot 9, Concession IX. This is also the
location of the outlet of the Sam Lindsay Award Drain No. 1.
3.2 BRANCH A
This section of the municipal drain
services mainly the area north of the 9th Concession between
Lots 9 and 12.
Branch A is 921 metres (3018 feet) in
length. The drainage area contributing to Branch A is
approximately 34.6 hectares (85.5 acres). The outlet of Branch
A is at Station 0 + 345.0 of the Main Drain.
3.3 BRANCH B
This 42 metre (138 foot) drain extends
from Branch A through a localized low area on Lot 10, Concession
IX to the roadside ditch of the 9th Concession Road.
This branch drains approximately 1.8
hectares (4.4 acres) and outlets at Station 0 + 137.0 of Branch
A.
3.4 WORKING SPACE AND DISPOSAL OF MATERIAL
In accordance with Sections 16 and 63,
the designated working space for the closed drain shall be a strip
of land centred on the course of the drain and 20 metres in width.
The owners of lands on which construction
is to be completed shall designate the access route to and from
the working space.

4,0 ALLOWANCES
In accordance with Sections 29 to 33,
where applicable, of the Drainage Act, 1975, the allowances payable
to owners entitled thereto were determined as outlined in Table 1 and
as described below:
4.1 ALLOWANCES FOR DAMAGE (SECTION 30)
This is compensation for any damage to
trees, fences, land and crops occasioned by the disposal of
material removed from the drainage works and as caused by obtain-
ing a suitable access from public roads.
Other allowances as specified in the
Drainage Act, 1975, are deemed not applicable to the Norman
MacArthur Municipal Drain.
Allowances shall become due in accordance
with Sections 62(3) and (4).

6.0 ASSESSMENTS
The sum of $83,079.00 shall be assessed
to the lands and roads using the Norman MacArthur Municipal Drain as
an outlet or receiving benefit from the construction as set out on
Table 3, Schedule of Assessments. Should the actual cost of the work
differ from the estimated cost, the actual cost shall be charged against
the said lands and roads in the same proportion as the estimated cost.
The total cost shall be assessed as
benefit or outlet liability in accordance with the Schedule of Assessments.
Injurying liability is deemed not applicable.
In accordance with Section 26 of the
Drainage Act, 1975, a special assessment has been made against the
Township of Kincardine for the cost of constructing the drainage works
across the road allowance. The special assessment is the increased cost
of the drainage works due to the roadway. The special assessment shall
be composed of the actual cost of this work less the cost for equivalent
field drain costs plus administration costs. The special assessment
shall not apply when pro- rating future maintenance costs.
It is anticipated that a Provincial grant
equal to one -third of the assessment on agricultural land will be
received, and if so, the assessment on the agricultural land shall be
reduced accordingly.
Table 4 outlines the estimated net cost
of the Norman MacArthur Municipal Drain.
Note: For the purpose of Section 85, all lands assessed are agricultural unless
marked thus *, as extracted from the last revised assessment roll.

As noted in Section 6.0, Assessments,
the special assessment against the Township of Kincardine shall not
apply when pro- rating future maintenance costs.
After construction, the drainage works
shall be maintained by the Municipality of the Township of Kincardine
at the expense of lands and roads assessed herein for benefit and outlet
and in the same relative proportion until said assessment shall be
varied according to the provisions of the Drainage Act, 1975.
