HomeMy WebLinkAboutKIN 86 4735 License Refresh Veh THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW NO. 4735 . A BY-LAW FOR VEHICLES FROM CONSUMPTION BY LICENSE. LICENSING, REGULATING AND GOVERNING WHICH REFRESHMENTS ARE SOLD FOR THE PUBLIC AND FOR REVOKING ANY SUCH WHEREAS pursuant to the provisions of the Municipal Act, R.S.O. 1980, Chapter 302, Section 232, paragraph 11, this Council is authorized to pass a by-law for licensing, regulating and governing vehicles from which refreshments are sold for consumption by the pUblic and for revoking any such license; AND WHEREAS it is considered advisable and expedient to enact a by-law for such purpose; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF KINCARDINE ENACTS AS FOLLOWS: 1. A "vehicle" includes a motor vehicle, trailer, traction engine, farm tractor, road-building machine and any vehicle drawn, propelled or driven by any kind of power, including muscular power, but does not include a motorized snow vehicle or the cars of electric or steam railways running only upon rails; 2. (a) The owner of every vehicle from which any food or refreshments are to be sold within the corporate limits of the Corporation of the Town of Kincardine, shall first obtain from the clerk, a license therefor; (b) No person shall sell any food or refreshment from any vehicle within the corporate limits of the corporation of the Town of Kincardine without having first obtained a license as set out herein; 3. The clerk, before issuing any such license, shall obtain the approval of Council and obtain from the fire chief and Local Board of Health a report and favourable recommendation regarding the construction and equipment of the vehicle to which the application for license refers; 4. The license fee to each owner for the first vehicle shall be $200.00 per year and $50.00 per year for each subsequent vehicle; 5. The following regulations shall be strictly owners and operators of all vehicles from refreshments are sold for consumption by the observed by the which food or public: (a) The interior walls and ceiling of such vehicle shall be painted and finished with enamel or other washable type of paint. (b) The heating units used in any such vehicle for the preparation of food shall be of a smokeless type and must be vented to prevent the escape of gasses and carbon monoxide which may contaminate food; (c) All foods and protected against and flies; refreshments shall be adequately contamination from droplet infection (d) All uncooked foods shall be maintained at all times in a clean sanitary condition; · e, -2- (e) Provisions shall be made for the disposal of all waste materials including paper containers so that the same shall be disposed of in such a manner that the area in which such a vehicle is parked shall be kept free from garbage, refuse and waste water at all times; (f) a vehicle shall wear which shall All persons engaged in the operation of such including their assistants or employees washable white or light coloured clothing be kept clean at all times; (g) All such operators and their employees shall satisfy the medical officer of health as to their freedom from communicable disease and shall submit to X-Ray examinations or such other tests as the medical officer of health may require; 6. Any license issued pursuant to the provisions of this by-law may be revoked by direction of this Council upon the production before it of evidence indicating that any of the regulations contained in this by-law have not been observed; 7. Every owner issued with a license under this by-law shall cause his license to be prominently and permanently dis- played in or on the vehicle during the full term in which he is carrying on business under authority of this license and in default thereof is guilty of an offence and on con- viction is liable to a fine of not less than one dollar ($l.OO) and not more than ten dollars ($lO.OO); 8. Any person who contravenes any of the provisions of this by- law shall, upon conviction, be liable to payment of a fine for each contravention thereof of not more than $300.00 exclusive of costs.
