HomeMy WebLinkAboutKIN 86 4742 Authorize Sale/Ld . . THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW 4742 A BY-LAW TO AUTHORIZE THE SALE OF LAND. WHEREAS the Corporation of the Town of (hereinafter referred to as the Corporation) at one the lands described in Schedule "A" attached hereto; Kincardine time owned AND WHEREAS the said Corporation sold and conveyed the firstly described land to Harold William MCIntosh by deed registered in the registry office in Walkerton on November 10, 1959 as Instrument 14624 and the secondly described land to Audrey Forbes and Madeline Scott as executrices of Harold William McIntosh by deed registered in the registry office in Walkerton on February 3, 1967 as instrument number 54094 without by-laws authorizing said sales having first been passed. AND WHEREAS the resolutions of Council for and September 23, 1966; AND WHEREAS the necessary for the purposes said sales had been authorized by the said Corporation on May 6, 1955 said lands were and are no longer of the Corporation; THEREFORE the Council of the Corporation of the Town of Kincardine ENACTS as follows: 1. That the said sales from the Corporation to Harold William McIntosh and Audrey Forbes and Madeline Scott as executrices of Harold William McIntosh of the two parcels of land described in Schedule "A" attached hereto as evidenced by deeds registered in the registry office at Walkerton on November 10, 1959 as instrument number 14624 and February 3, 1967 as instrument number 54094 are hereby approved, ratified and confirmed. 2. And for this purpose, the mayor authorized to execute such documents connection therewith to effect same. and clerk are hereby as may be necessary in 3. That By-law 4739 passed on the 5th day of June 1986 be and the same is hereby repealed. THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW 4742 SCHEDULE "A" Part of the Westerly half of Lot number 1 in the subdivision of lot 6 and 7 on the East side of Huron Terrace Street, plan 61 which part may be more particularly described as follows: FIRSTLY COMMENCING at the Northwesterly THENCE in an Easterly direction lot 1 a distance of 53 feet to of beginning; Thence continuing Easterly along the Northerly limit of said lot 1 a distance of 3 feet to a point where the said Northerly limit of said lot 1 is intersected by the line between the East and West halves of said lot 1; Thence southerly along the said line between the East and West halves of said lot 1 and perpendicular to the Northerly Limit of said lot 1 to the Southerly limit of said lot 1; THENCE Westerly along the Southerly limit of said lot 1 to the southwest angle of said lot 1; Thence Northerly along the Westerly limit of point distant 53 feet measured Southerly limit of said lot 1 from the Northwest angle Thence Northeasterly in a straight line Beginning; angle of said lot 1; along the Northerly limit of said a point, which point is the point said lot 1 to a in the said Westerly of said lot 1; to the Point of SECONDLY Part of the Westerly one-half of lot 1 in subdivision of lot 6 and 7 on the East side of Huron Terrace Street in the said Town of Kincardine described as follows: Commencing at the Northwesterly angle of said lot 1; thence in an Easterly direction along the Northerly limit of said lot 1 a distance of 53 feet to a point; Thence in a Southwesterly direction in a straight line to a point in the Westerly limit of said lot 1, distant 53 feet measured Southerly thereon from the northwesterly angle of said lot 1; Thence in a Northerly direction along the Westerly limit of said lot I a distance of 53 feet to the Point of Commencement and now as shown on plan 61 for the Town of Kincardine.
