THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY-LAW
NO. 2009 - 148
BEING A BY-LAW TO ENTER INTO A CONTRACT FOR ARCHITECTURAL
SERVICES FOR THE RESTORATION OF THE KINCARDINE ARTS CENTRE
(The Ventin Group)
WHEREAS Sections 11 (1) and (3) of the Municipal Act, 2001, S.O. 2001, c. 25
as amended gives broad authority to lower-tier municipalities to provide any
service or thing that the municipality considers necessary or desirable for the
public and authorizes lower-tier municipalities to pass by-laws respecting culture,
parks, recreation and heritage;
AND WHEREAS pursuant to the said Municipal Act, Sections 8 (1) and 9 provide
that the powers of a municipality under this or any other Act shall be interpreted
broadly so as to confer broad authority on the municipality to enable the
municipality to govern its affairs as it considers appropriate and to enhance the
municipality's ability to respond to municipal issues and a municipality has the
capacity, rights, powers and privileges of a natural person for the purpose of
exercising its authority under this or any other Act;
AND WHEREAS the Municipality of Kincardine received monies under Intake 2 of
the Building Canada Fund Grant for the restoration of the Kincardine Arts Centre;
AND WHEREAS the Council of The Corporation of the Municipality of Kincardine
deems it advisable to enter into a Contract for Architectural Services with The
Ventin Group for the restoration of Kincardine Arts Centre;
NOW THEREFORE the Council of The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That The Corporation of the Municipality of Kincardine enter into a Contract for
Architectural Services with The Ventin Group to purchase and receive the
services necessary for restoration of the Kincardine Arts Centre at 6.9% of the
total project cost as provided in the Request for Proposal attached to this
By-law as Schedule 'A'.
2. That the Mayor and Chief Administrative Officer be authorized and directed to
execute by affixing their signatures and the corporate seal, on behalf of The
Corporation of the Municipality of Kincardine, any contracts and other
documentation required to authorize such work to commence.
3. This by-law shall come into full force and effect upon its final passage.

Cost control on special-purpose heritage building projects is often difficult for other architects, because they
lack pricing information on an identical scope of work. Detailed comparative analysis is required to accurately
develop realistic budgets, and then meet them during design. +YG has a wealth of comparative cost
information for historic restoration projects.
1.1.1 Demonstrated Ability to Handle an Assignment of this Scope
Every public heritage project is subject to intense scrutiny, with high
expectations from local interest groups. Kincardine Council will
benefit from the support of experienced heritage architecture
specialists.
Our method of enhancing prominent heritage assets is based upon a
balanced approach to the process. which will satisfy public observers,
yet enable the Town to complete the project in the most practical,
cost-effective manner possible.

participation in organizations like the Canadian Association of Heritage
Professionals (CAHP). + YG Partner Peter Berton has served on the
Board and has been Treasurer of this organization.

The conversion of historic Loretto Convent (c.1854) to
relocate the City of Guelph Civic Museum is the most
ambitious projects in Ontario to date, to target LEED@ Silver
certification.
Loretto Convent is located on the most prominent site in
downtown Guelph. The Convent is the oldest existing school
building in Guelph and an excellent example of mid-
nineteenth century, limestone architecture. But this structure
has been neglected for decades. The building has been
derelict for 12 years and as-found condition presents many
challenges.
In communities across Ontario, + VG Architects has
demonstrated unparalleled expertise with exactly these
challenges. In nearby Waterloo Region, our work at historic
Castle Kilbride Museum began with a building in far worse
condition. When we were finished, the museum was
designated as a National Historic Site, solely because of our
meticulous restoration of the unique interior elements.
+ VG will redesign Loretto Convent to house the current museum program, plus a new Children's Gallery and
a Local History of Guelph Gallery. The design will incorporate the City of Guelph Facility Accessibility Standards
into the building, parking lot and exhibit design.

The design intention is not to copy the historic elements of the existing building in the new addition, but rather
to complement them using appropriate scale, detail and the addition of modern materials. Phase I, insertion of

New 400 seat community theatre addition. incorporated with
renovation of historic Town Hall (c. 1901). The success of
this project depended on the environmental safeguarding and
the performance of its building systems in both the new and
restored areas.

structural, mechanical and electrical building systems to
develop a sustainable, long-term efficient and cost effective
life cycle performance. Our building science expertise
ensured that the heritage structure was protected and
maintained for the designed life of the new facility.
